VOGTLE ELECTRIC GENERATING PLANT, UNITS 1 AND 2, MEASUREMENT UNCERTAINTY RECAPTURE POWER UPRATE APPLICATION (TAC NOS.

MD6625 AND MD6626)

Dear Mr. Tynan:

In a letter dated August 28, 2007, and supplemented by letter dated October 9, 2007, Southern Nuclear Operating Company (SNOC) submitted an application requesting to increase the licensed thermal power level for the Vogtle Electric Generating Plant, Units 1 and 2. The proposed amendment would increase the licensed core power level by 1.7 percent to 3625.6 megawatts thermal with the installation of the Caldon Check-Plus ultrasonic feedwater flow element.

We note that your August 28, 2007, letter requested the staffs decision on your application by March 1, 2008, and that the staffs review conducted to date has included considerable attention to the radiological dose analyses that require revision to support the application. While the staffs guidance in Regulatory Issue Summary 2002-03, dated January 31, 2002, (RIS) did encourage clear identification of subject areas that would and would not be affected by an MUR application, it has not been the staffs general expectation that this would include substantial revisions to radiological dose analyses or the supporting atmospheric dispersion analysis, high-pressure turbine modifications, and the minimum departure from nucleate boiling ratio calculations based on VIPRE. Based on the review conducted to date, we anticipate that the potential complexity of these review issues may result in a challenge to completion of the MUR review within the typical timeframes discussed in the RIS. In that regard, the most expeditious response by SNOC to staff needs for additional information could contribute to minimizing such extensions of the review schedule.

While noting the above, we wish to inform you that, based on the information contained in your application and its supplement, as compared to the RIS, the staff has determined that SNOC has provided the necessary information for the NRC staff to begin a detailed technical review.
