DUANE ARNOLD ENERGY CENTER - SCHEDULE FOR PROCESSING AMENDMENT REQUEST TO CHANGE TECHNICAL SPECIFICATION SECTIONS 3.7.4 AND 5.5.13 BASED ON MODEL TEXT FROM TECHNICAL SPECIFICATION TASK FORCE CHANGE TRAVELER TSTF-448, REVISION 3, "CONTROL ROOM ENVELOPE HABITABILITY" (TAC NO. MD6020)

Dear Mr. Van Middlesworth:

By letter to the Nuclear Regulatory Commission dated June 29, 2007, you applied for an amendment to Duane Arnold Energy Center (DAEC) Operating License No.05-331. The proposed amendment would change Technical Specifications (TS) Sections 3.7.4 and 5.5.13 to strengthen TS requirements regarding control building envelope (CBE) habitability. The proposed change would modify action and surveillance requirements associated with the limiting condition for operation operability requirements for the CBE standby filter unit and add a new TS administrative controls program on CBE habitability. The proposed changes to the TS and associated Bases are consistent with certain exceptions with standard technical specifications (STS) as revised by TS Task Force (TSTF) Change Traveler No. 448 (TSTF-448), Revision 3, "Control Room Envelope Habitability" to the extent that the amendment request adopts by reference certain model TSTF-448, Revision 3 content, where applicable.

In your application letter of June 29, 2007, you stated that you were requesting the revision to the TS under the consolidated line item improvement process (CLIIP). The NRC staff has performed an acceptance review of your application letter. Our review indicates that your amendment request cannot be processed under a CLIIP schedule because of the exceptions to the model safety evaluation dated January 9, 2006, which is associated with TSTF-448, Revision 3.

G. Middlesworth Our current planning for this application for amendment would be to have a response to you prior to June 15, 2008. We anticipate providing a request for additional information (RAI) prior to the end of October, 2007. In a phone call on September 5, 2007, with Tony Browning of your staff, I stated that your application letter did not contain a requested date for the response. It was agreed that DAEC would provide a requested date as part of its response to the RAI or by separate correspondence prior to its response to the RAI.
