CALLAWAY PLANT, UNIT 1 - COMPLETION OF ACCEPTANCE REVIEW OF REQUEST TO UPGRADE EMERGENCY ACTION LEVELS BY ADOPTING NUCLEAR ENERGY INSTITUTE (NEI) 99-01, REVISION 4 (TAC NOS. MD5154 AND MD5771)

Dear Mr. Naslund:

By letter dated March 27, 2007 (ULNRC-05365), AmerenUE (Union Electric Company) submitted a proposed revision of the emergency action levels (EALs) in the radiological emergency response plan for the Callaway Plant, Unit 1 (Callaway). The proposed EAL revision is to adopt the Nuclear Regulatory Commission (NRC)-endorsed NEI 99-01, Methodology for Development of Emergency Action Levels, Revision 4, dated January 2003.

In the letter, AmerenUE requested approval of the proposed EAL upgrade by August 1, 2007.

In its later letter dated June 4, 2007 (ULNRC-05417), AmerenUE submitted additional information on its request to upgrade EALs and revised the date it requested approval to June 4, 2008, 1 year from the receipt of its June 4, 2007, letter. As explained in the letter, the NRC staff, in the conference call of May 10, 2007, identified information that was missing from, or unreadable in, the March 27, 2007, letter, and stated that the requested approval date of August 1, 2007, was unrealistic. This missing and unreadable information was provided in the letter dated June 4, 2007.

With the information in the June 4, 2007, letter, the NRC staff can begin its review of the request to upgrade the EALs by adopting NEI 99-01, Revision 4. Also, the revised completion dated of June 4, 2008, is realistic and we hope that we may be able to better that date. With this letter, TAC MD5154, which was taken out for the March 27, 2007, letter, is closed, and the TAC MD5771 will cover the review.
