Dear Mr. Nazar:
I am responding to a letter from Mr. Mark A. Peifer, dated May 11, 2007, withdrawing Donald C.
Cook Nuclear Plant (DCCNP) as a pilot plant for the elimination of automatic containment spray actuation. Since NRCs fee waiver of the DCCNP license amendment for the implementation of this water management strategy was based on the DCCNP being a pilot, I am rescinding DCCNPs fee waiver, effective immediately. Staff reviews conducted before today on the subject issue were covered by the fee waiver.
By letter dated October 13, 2006, NRCs Chief Financial Officer, granted Indiana Michigan Power Company (I&M) a fee waiver under the provisions of 10 CFR Part 170.11(b)(1). This was in response to I&Ms September 15, 2006, letter requesting a fee waiver for the NRCs review of a yet-to-be-submitted license amendment request for DCCNP. The fee waiver was granted on the basis that DCCNP was accepted as a pilot plant. Since DCCNP will no longer participate as a pilot plant, any future licensing review of the subject issue will be fee billable.
