Letter from Joseph N. Jensen, Indiana Michigan Power Company, to U. S. Nuclear Regulatory Commission Document Control Desk, "Request for Approval of Risk-Informed Inservice Inspection Program for Class 1 and 2 Piping American Society of Mechanical Engineers Code, Category B-F, B-J, C-F-i, and C-F-2 Piping Welds', AEP:NRC:6055-09, dated September 29, 2006.

In the referenced letter, Indiana Michigan Power Company (I&M), the licensee for Donald C. Cook Nuclear Plant Units 1 and 2, submitted a request to adopt a risk-informed inservice inspection (RI-ISI) program for certain piping welds. I&M's proposed program is based on American Society of Mechanical Engineers (ASME) Code Case N-716. In making the request, I&M volunteered to be the Pressurized Water Reactor (PWR) pilot plant for an RI-ISI program based on ASME Code Case N-716.

The provisions of 10 CFR 170.11(a)(1)(ii) and (iii) state that no application fees, license fees, renewal fees, inspection fees, or special project fees shall be required to assist the Nuclear Regulatory Commission (NRC) in developing a rule, regulatory guide, policy statement, generic letter, or bulletin; or as a means of exchanging information between industry organizations and the NRC for the specific purpose of supporting the NRCs generic regulatory improvements or efforts.

In that the I&M development and NRC review of the licensing actions required for the implementation of a PWR RI-ISI program based on ASME Code Case N-716 supports the NRC effort in the development of an RI-ISI policy, I&M requests a waiver of the associated NRC fees. It is I&M's understanding that the fee waiver would be applicable to the complete NRC review of I&M's proposed RI-ISI program.
