PRELIMINARY INFORMATION - NOT FOR PUBLIC DISCLOSURE UNTIL VERIFICATION THAT LICENSEE HAS RECEIVED ACTION April 17, 2007 EN-07-022 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Carolina Power and Light Company (EA-07-024)

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or about April 20, 2007, to Carolina Power and Light Company as a result of inspections conducted at Brunswick Steam Electric Plant. This White finding, an issue of low to moderate safety significance which may require additional NRC inspection, involved (1) inadequate corrective actions to prevent a repeat failure of the

  1. 9 main crankshaft bearing on emergency diesel generator (EDG) #1, (2) the failure to follow the foreign material exclusion procedure during maintenance performed on EDG #1, and (3) the failure to promptly identify and implement adequate actions to prevent EDG #1 from tripping on low lubricating oil pressure. These conditions ultimately contributed to an EDG #1 trip and a bearing failure during a Unit 2 loss-of-offsite-power event on November 2, 2006, as well as the Unit 1 failure to satisfy the requirements of a 7-day technical specification limiting condition for operation because only three of four EDGs were operable from October 30, 2006, until the condition was corrected on November 7, 2006. Because plant performance for this issue has been determined to be at least in the regulatory response band, the staff plans to use the NRC Action Matrix to determine the most appropriate NRC response for this event.

A Notice of Violation is included based on a violation of Technical Specification 3.8.1, AC Sources-Operating, because EDG #1 was inoperable from October 30 to November 7, 2006.

As a result, while Unit 1 was operating in Mode 1, only three of four EDGs were operable for a period in excess of 7 days.

It should also be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
