Dear Mr. Crane:
By letter to the Nuclear Regulatory Commission (NRC) dated January 22, 2007, Exelon Generation Company, LLC, and AmerGen Energy Company, LLC (the licensees), requested approval for a change to the Quality Assurance Topical Report. Approval of this request would be applied to licensed activities under Title 10 of the Code of Federal Regulations (10 CFR),
Parts 50, 71, and 72, for the subject units. The licensees stated in their letter that the change requested for approval is a reduction in commitment. In accordance with 10 CFR 50, Section 50.54(a)(4), NRC prior approval is required prior to implementation. This change request also affects licensed activities under Parts 71 and 72. Review of this change as it pertains to Parts 71 and 72 will be addressed, by the NRCs Office of Nuclear Material Safety and Safeguards, in a separate correspondence.
The NRC staff has reviewed the information contained in the request and has determined that additional information is required to complete the review as it pertains to Part 50. The specific information requested is addressed in the enclosure to this letter. The NRC staff faxed a draft copy of the information request to Mr. David Chrzanowski on March 21, 2007. On March 23, 2007, the NRC staff held a conference call with Mr. Darin Benyak and Mr. Chrzanowski to clarify the information request. During that conference call, it was agreed that your staff would respond to the request by April 23, 2007.
The NRC staff considers that timely responses to requests for additional information help ensure sufficient time is available for staff review and contribute toward the NRCs goal of efficient and effective use of staff resources. Regulatory Issue Summary (RIS)99-002, Relaxation of the Technical Specification [TS]
Requirements for [Plant Operating Review Committee] PORC Review of Fire Protection Program Changes, identifies a method of meeting requirements for PORC review of the fire protection program and its implementing procedure.
RIS 99-002, Background Information, states:
The following regulatory controls in effect contribute to ensuring the continued effectiveness of the FitzPatrick fire protection program:
(1)
The FitzPatrick license includes a license condition that the licensee may make changes to the approved fire protection program without prior Commission approval only if those changes would not adversely affect the ability to achieve and maintain safe shutdown in the event of a fire.
(2)
Since the fire protection program is included in the FitzPatrick final safety analysis report, the provisions of 10 CFR 50.59 apply; this regulation prohibits changes to the facility without prior Commission approval if it is determined that the change constitutes an unreviewed safety question.
(3)
The FitzPatrick technical specifications require the Safety Review Committee to inspect and audit the fire protection program.
(4)
The FitzPatrick technical specifications require written procedures and administrative policies to implement the fire protection program.
The NRC staff noted that item (3) above was not discussed in your January 22, 2007, letter.
Please describe how the Quality Assurance Topical Report establishes a requirement for the inspection and audit of the fire protection program.
