PRELIMINARY INFORMATION - NOT FOR PUBLIC DISCLOSURE UNTIL VERIFICATION THAT LICENSEE HAS RECEIVED ACTION February 15, 2007 EN-07-007 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Arizona Public Service Company (EA-06-296)

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or around February 21, 2007, to Arizona Public Service Company as a result of inspections at the Palo Verde Nuclear Generating Station, Unit 3. This White finding, an issue of low to moderate safety significance which may require additional U.S. Nuclear Regulatory Commission inspection, involved the failures of the Unit 3, Train A Emergency Diesel Generator (EDG A) to perform its safety function when tested on July 25 and September 22, 2006. This action will move Palo Verde Unit 3 to the multiple/repetitive degraded cornerstone column of the NRCs Action Matrix.

A Notice of Violation is included based on a violation of 10 CFR 50, Appendix B, Criteria V, Instructions, Procedures, and Drawings and a violation of 10 CFR 50, Appendix B, Criteria XVI, Corrective Action. Specifically, the licensee failed to develop appropriate instructions or procedures for corrective maintenance activities on the Unit 3, EDG A K-1 relay and did not identify and correct the cause of the erratic K-1 relay operation prior to installation of the relay on July 26, 2006. (The K-1 relay is a key component, which must operate properly in order for the EDGs mechanical output to be converted and routed as electricity for safety components during certain types of accidents.) These failures by the licensee resulted in the emergency diesel generator being in a condition of reduced reliability between July 26, 2006, and September 4, 2006, and inoperable between September 4 and September 22, 2006.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
