ENERGY NORTHWEST NUCLEAR PROJECT NO. 1 - TERMINATION OF CONSTRUCTION PERMIT CPPR-134 (TAC NO. MC9245)
Dear Mr. Parrish:
This is in response to your letter of August 9, 2005, as supplemented by letter dated July 7, 2006, requesting termination of Construction Permit No. CPPR-134, issued to Washington Public Power Supply System (permittee, now conducting business as Energy Northwest) on December 23, 1975. Construction Permit No. CPPR-134 authorized construction of Nuclear Project No. 1 (WNP-1). As requested in your letter of August 9, 2005, your application to withdraw Construction Permit No. CPPR-134 is hereby granted; accordingly, the staff considers Construction Permit No. CPPR-134 to be terminated. Because the construction permit for Unit 4 (WNP-4) was effectively subsumed in the Unit 1 construction permit on November 27, 1985, the Nuclear Regulatory Commission (NRC) oversight of WNP-4 is also terminated.
The NRC staff has reviewed the WNP-1 Site Restoration Plan, included in your letter of August 9, 2005, as supplemented by letter dated July 7, 2006, and concludes that Energy Northwest has maintained the site in an environmentally-stable condition and that the plant is not capable of being operated as a utilization facility. Therefore, the staff finds the Site Restoration Plan acceptable.
The NRC staffs safety evaluation is enclosed.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION WITHDRAWAL OF CONSTRUCTION PERMIT NO. CPPR-134 ENERGY NORTHWEST NUCLEAR PROJECT NO. 1 (WNP-1)

1.0 INTRODUCTION
This safety evaluation supports withdrawal of Construction Permit No. CPPR-134, which authorized construction of the Washington Public Power Supply System (permittee, now conducting business as Energy Northwest), Nuclear Project No. 1 (WNP-1) located on the Department of Energys Hanford Reservation in Benton County, Washington. The Construction Permit, which is held by Energy Northwest, was issued on December 23, 1975. Because the construction permit for Unit 4 (WNP-4) was effectively subsumed in the Unit 1 construction permit on November 27, 1985, this safety evaluation applies to both WNP-1 and WNP-4.
In accordance with the guidance of Generic Letter (GL) 87-15, Policy Statement on Deferred Plants, Energy Northwests letter of August 9, 2005, informed the staff of its intention to permanently terminate construction activities associated with WNP-1. In addition, Energy Northwests letter dated August 9, 2005, included the following information: due to the early deferral and subsequent termination of construction, there is no nuclear fuel at the site and the plant is not capable of being operated as a "utilization facility."
2.0 EVALUATION The WNP-1 facility is located about 8 miles north of Richland, Washington in Benton County.
In accordance with Section 51.41 of Title 10 of the Code of Federal Regulations (10 CFR),
Requirement to submit environmental information, and GL 87-15, Energy Northwests letter of August 9, 2005, as supplemented by letter dated July 7, 2006, submitted the Site Restoration Plan for WNP-1, to redress portions of the WNP-1 site affected by construction activities.
The Nuclear Regulatory Commission (NRC) staff has reviewed the Site Restoration Plan for WNP-1, and concludes that the actions therein are appropriate and acceptable. WNP-1 and WNP-4 cannot be used as utilization facilities. In addition, the NRC staff conducted an audit of the site area encompassing WNP-1 and WNP-4 on April 24 and 25, 2006, to determine whether possession of source, byproduct, or special nuclear material was controlled as authorized, to determine whether the site area is being maintained in a safe and stable manner, and to assess key environmental aspects of the site. The NRC staff assessed the effectiveness of the measures already taken under the near term phase of the site restoration plan and concluded that restoration activities appear to meet the goals and objectives of Washington State Energy Facility Site Evaluation Council Resolution No. 302. The WNP-1 site is in an environmentally stable condition that poses no significant hazard to persons on site and cannot be operated in its present condition.
3.0 ENVIRONMENTAL CONSIDERATION
Pursuant to 10 CFR 50.21, 50.32, and 50.35, the NRC staff has prepared an Environmental Assessment and Finding of No Significant Impact, which was published in the Federal Register on September 7, 2006 (71 FR 52824). Accordingly, based on the environmental assessment, the Commission has determined that terminating the construction permits will have no significant effect on the quality of the human environment.
4.0 CONCLUSION
On the basis of the foregoing considerations, the staff concludes that CPPR-134 can be terminated without undue risk to the health and safety of the public or workers, and without any significant impact on the public or the environment.
