OYSTER CREEK NUCLEAR GENERATING STATION - ADMINISTRATIVE CHANGE TO FACILITY OPERATING LICENSE IN CONJUNCTION WITH THE COMMISSION ORDER EA-06-037 REGARDING UPDATED DESIGN-BASIS THREAT AND REVISIONS TO PHYSICAL SECURITY PLAN, TRAINING AND QUALIFICATION PLAN, AND SAFEGUARDS CONTINGENCY PLAN (TAC NO. MD2254)

Dear Mr. Crane:

By letters to the Nuclear Regulatory Commission (NRC) dated May 17, 2006, and October 13, 2006, AmerGen Energy Company, LLC (AmerGen or the licensee) submitted its revised plans and confirmed the full implementation at the Oyster Creek Nuclear Generating Station (Oyster Creek) of Order EA-06-037 regarding an updated adversary characteristic in the design basis threat.

The NRC staff has completed its review of the changes related to implementation of Order EA-06-037. As discussed in the enclosed safeguards evaluation (Enclosure 2), the NRC staff has determined that the licensees changes to the security plans meet the requirements of the NRC Order and Title 10 of the Code of Federal Regulations (10 CFR) Part 73 requirements and are, therefore, acceptable. The effectiveness of these security provisions will continue to be the subject of NRC review and inspection.

Consistent with the Order, a conforming administrative change to the Facility Operating License is required to ensure implementation of Order EA-06-037 requirements.

NOTICE: Enclosure 2 contains Security-Related Information. Upon separation from Enclosure 2, this letter and Enclosure 1 are DECONTROLLED.

These changes comply with the standards and requirements of the Atomic Energy Act of 1954, as amended, and the Commission's rules and regulations set forth in 10 CFR Chapter I. Please replace page 4 of your Facility Operating License (Enclosure 1).

Inspections of core spray spargers, piping and associated components will be performed in accordance with BWRVIP-18, BWR Core Spray Internals Inspection and Flaw Evaluation Guidelines, as approved by NRC staffs Final Safety Evaluation Report dated December 2, 1999.

Reactor Vessel Integrated Surveillance Program AmerGen Energy Company, LLC, is authorized to revise the Updated Final Safety Analysis Report (UFSAR) to allow implementation of the Boiling Water Reactor Vessel and Internals Project reactor pressure vessel Integrated Surveillance Program as the basis for demonstrating compliance with the requirements of Appendix H to Title 10 of the Code of Federal Regulations Part 50, Reactor Vessel Material Surveillance Program Requirements, as set forth in the licensees application dated December 20, 2002, and as supplemented on May 30, September 10, and November 3, 2003.
