September 21. 2006MEMORANDUM TO:William H. Ruland, DirectorLicensing and Inspection Directorate Spent Fuel Project Office, NMSSFROM:James R. Hall, Senior Project Manager /RA/Licensing Section Spent Fuel Project Office, NMSS

SUBJECT:

SUMMARY

OF THE SEPTEMBER 12, 2006, MEETING WITH DUKEPOWER TO DISCUSS OCONEE ISFSI LICENSE RENEWALOn September 12, 2006, staff from the U.S. Nuclear Regulatory Commission's (NRC) S pentFuel Project Office (SFPO) met with representatives from Duke Power Company (DPC) to discuss the licensee's plans to submit a license renewal application for the Oconee independent spent fuel storage installation (ISFSI). The Oconee ISFSI uses the Standardized NUHOMS drycask storage system. Approximately 40 horizontal storage modules have been loaded underthe licensee's 10 CFR Part 72 site-specific license, issued by NRC in January 1990, to expire in2010. Duke also operates part of its ISFSI at Oconee under the general license (GL) provisions of 10 CFR Part 72, but the initial loading of storage modules under the GL did not commence until 1999. DPC indicated that its planned application will focus only on the renewal of the site-specific license.DPC stated that it had closely followed the NRC review of the Surry and H. B. Robinson ISFSIlicense renewals, which were approved in early 2005. DPC intends to apply the same preliminary renewal guidance provided by NRC staff to those licensees. SFPO staff indicatedthat we are currently incorporating that guidance into a formal Standard Review Plan, a draft ofwhich may be available for comment in early 2007. SFPO staff identified other reference documents for the licensee to consider in preparing its application, including SFPO Interim Staff Guidance 15, "Materials Evaluation," and "Standard Guide for Evaluation of Materials Used inExtended Storage of Interim Spent Nuclear Fuel Dry Storage Systems," American Society forTesting and Materials, ASTM C1562-03, March 2003. SFPO indicated that the focus of therenewal review is to ensure that the ISFSI components and materials that are important tosafety will continue to perform their intended functions throughout the renewal period. Therenewal application should describe how that determination will be made. The staff pointed outthat the previous ISFSI renewal applications employed a combination of analysis, aging management and maintenance programs, and sample inspection activities.DPC also indicated its intention to request an exemption to allow the ISFSI renewal period to beextended beyond 20 years, but has not decided on the length of the extended term. Thelicensee expects to store fuel in the ISFSI for several years beyond final shutdown of the three reactors (the operating licenses have been renewed through 2034), and stated that the fuel in dry storage would likely be the last fuel shipped offsite. SFPO staff indicated that Surry and Robinson justified a 40-year renewal period for their requested exemptions, but DPC could ask for something other than 40 years, with an appropriate technical basis for the extended renewal W. Ruland term based on materials, history, and environment. Although not the focus of this meeting, theSFPO staff stated that NRC is working on a rulemaking to develop a process for renewingCertificates of Compliance and general licenses for ISFSIs. DPC plans to submit the Oconee site-specific ISFSI license renewal application, and associated exemption request, for NRC review in the 4 th quarter of 2007. No regulatory decisions were requested nor made at the meeting. A list of meeting attendeesis provided as Enclosure 1. The slides presented by DPC are provided as Enclosure 2.Docket Nos.72-04, 50-269, 50-270, 50-287TAC No.L24010
