SUMMARY

OF THE SEPTEMBER 12, 2006, MEETING WITH DUKE POWER TO DISCUSS OCONEE ISFSI LICENSE RENEWAL On September 12, 2006, staff from the U.S. Nuclear Regulatory Commissions (NRC) Spent Fuel Project Office (SFPO) met with representatives from Duke Power Company (DPC) to discuss the licensees plans to submit a license renewal application for the Oconee independent spent fuel storage installation (ISFSI). The Oconee ISFSI uses the Standardized NUHOMS dry cask storage system. Approximately 40 horizontal storage modules have been loaded under the licensees 10 CFR Part 72 site-specific license, issued by NRC in January 1990, to expire in 2010. Duke also operates part of its ISFSI at Oconee under the general license (GL) provisions of 10 CFR Part 72, but the initial loading of storage modules under the GL did not commence until 1999. DPC indicated that its planned application will focus only on the renewal of the site-specific license.

DPC stated that it had closely followed the NRC review of the Surry and H. B. Robinson ISFSI license renewals, which were approved in early 2005. DPC intends to apply the same preliminary renewal guidance provided by NRC staff to those licensees. SFPO staff indicated that we are currently incorporating that guidance into a formal Standard Review Plan, a draft of which may be available for comment in early 2007. SFPO staff identified other reference documents for the licensee to consider in preparing its application, including SFPO Interim Staff Guidance 15, Materials Evaluation, and Standard Guide for Evaluation of Materials Used in Extended Storage of Interim Spent Nuclear Fuel Dry Storage Systems, American Society for Testing and Materials, ASTM C1562-03, March 2003. SFPO indicated that the focus of the renewal review is to ensure that the ISFSI components and materials that are important to safety will continue to perform their intended functions throughout the renewal period. The renewal application should describe how that determination will be made. The staff pointed out that the previous ISFSI renewal applications employed a combination of analysis, aging management and maintenance programs, and sample inspection activities.

DPC also indicated its intention to request an exemption to allow the ISFSI renewal period to be extended beyond 20 years, but has not decided on the length of the extended term. The licensee expects to store fuel in the ISFSI for several years beyond final shutdown of the three reactors (the operating licenses have been renewed through 2034), and stated that the fuel in dry storage would likely be the last fuel shipped offsite. SFPO staff indicated that Surry and Robinson justified a 40-year renewal period for their requested exemptions, but DPC could ask for something other than 40 years, with an appropriate technical basis for the extended renewal
