SAFETY EVALUATION REPORT - OTN-32 DRY STORAGE CASK TOPICAL SAFETY ANALYSIS REPORT," REVISION 9 (TAC NO. L21912)

Dear Mr. Dawson:

By application dated December 14, 1993, Transnuclear, Inc. (TN), submitted to the Nuclear Regulatory Commission for review and approval its "TN-32 Dry Storage Cask Topical Safety Analysis Report" (TSAR). As a result of NRC's requests for additional information, TN submitted TSAR Revisions 1 through 9 dated March 30, 1994; May 12, and October 20, 1995; and February 20, March 26, June 7, June 19, August 22, and September 5, 1996, respectively.

The NRC staff has completed its review of TN's application, supplements, and subsequent information and concludes that the TN-32 cask design meets the requirements of 10 CFR Part 72 for the receipt, handling, and storage of spent fuel. Therefore, the TSAR is suitable for referencing in a site-specific Part 72 license application. This acceptability is limited to the conditions detailed in this letter, the enclosed Safety Evaluation Report (SER), and the TSAR, as revised and supplemented.

The SER discusses how the cask design meets the specific requirements of 10 CFR Part 72 with respect to design, operation, and decommissioning. The SER also addresses normal and off-normal operating conditions and accidents.

The SER details the limitations and operating conditions applicable to fuel loading, onsite transfer, emplacement of a cask, cask storage operations, and surveillance. However, as stated in the SER, other technical specifications and limitations apply. Radiological, shielding, criticality, structural, and thermal aspects of the TN-32 cask design and the vendor's Quality Assurance Program were reviewed for compliance with applicable requirements of Subparts E, F, and G of 10 CFR Part 72.

Requirements for physical protection (10 CFR Part 73) and offsite transport of radioactive materials (10 CFR Part 71) are not within the scope of the TSAR and are not addressed in this review.

As a result of this TSAR approval, TN should provide within 30 days of the date of this letter an approved TSAR labeled "Revision 9A" (5 copies).

Revision 9A should incorporate (1) this letter, (2) the SER, and (3) a list of submittal dates for supporting supplemental information submitted after Revision 9 (September 5, 1996). Items 1, 2, and 3 should be inserted into Revision 9A following the title page. As stated in Regulatory Guide 3.48, 9611150166 961107 wil e C Y PDR ADOCK 07201021 PDR C

Mr. David H. Dawson proprietary information should be in a separate binder. For future reference, TN should retain 20 copies of Revision 9A. In addition, please provide an electronic version (Wordperfect format) of the TSAR, Revision 9A.

Accordingly, OTN-32 Dry Storage Cask Topical Safety Analysis Report,"

Revision 9 is acceptable as a reference in a Safety Analysis Report in a 10 CFR Part 72 site-specific spent fuel storage licensing application. Should NRC criteria or regulations change, such that our conclusions as to the acceptability of the TSAR are invalidated, TN will be expected to revise and resubmit its respective documentation or submit Justification for the continued applicability of the TSAR.
