BEAVER VALLEY POWER STATION BEYOND SCOPE ITEM NO. 30 (TAC NOS. MC6791 AND MC6792)
By application dated February 25, 2005, as supplemented by letter dated November 11, 2005, First Energy Nuclear Operating Company (FENOC) requested a full conversion from the current Technical Specifications (CTS) to a set of Improved Technical Specifications (ITS) based on NUREG-1431, "Standard Technical Specifications - Westinghouse Plants,"
Revision 2, for the Beaver Valley Nuclear Power Station (BVPS). In addition, Technical Specification Task Force (TSTF) changes were also incorporated to make the resulting BVPS ITS more consistent with Revision 3 of NUREG-1431.
This Safety Evaluation (SE) evaluates Beyond Scope Item No. 30 (BSI-30). BSIs are proposed changes that include revisions to NUREG-1431 as well as changes to the BVPS CTS.
This particular BSI is associated with Bases editorial changes to TS section 3.0.6, which are corrected by TSTF-482 Revision 0, which was approved on December 6, 2005, after the submittal of the ITS license amendment request.
Based on our review, the Technical Specifications Branch concludes that the proposed revisions to the BVPS ITS Bases are acceptable. Our safety evaluation is enclosed. This completes our efforts on TAC Numbers MC6791 AND MC6792.

Enclosure SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION BEAVER VALLEY NUCLEAR POWER STATION UNITS 1 AND UNITS 2 DOCKET NO. 50-334 AND 50-412
1.0 INTRODUCTION
By application dated February 25, 2005, as supplemented by letter dated November 11, 2005, First Energy Nuclear Operating Company (FENOC) requested a full conversion from the current Technical Specifications (CTS) to a set of Improved Technical Specifications (ITS) based on NUREG-1431, "Standard Technical Specifications - Westinghouse Plants,"
Revision 2, for the Beaver Valley Nuclear Power Station (BVPS). Included in this application was a proposed change to the TS Bases for TS 3.0.6 to incorporate TSTF-482, Revision 0 (Rev 0). TSTF-482, Rev 0, was issued to correct a bases error.
2.0 REGULATORY EVALUATION
The Commissions requirements related to the content of Technical Specifications are set forth in 10 CFR 50.36. This regulation requires that the licensee shall include in the application the bases or reasons for proposed TS changes, but the bases shall not become part of the technical specifications (TS).
3.0 TECHNICAL EVALUATION
3.1 Background
In this license amendment BVPS adopts TSTF-482 Revision 0, modifies the Bases of LCO 3.0.6 to be consistent with the statements in LCO 3.0.6 (this is known as Beyond Scope Item No. 30 in the BVPS license amendment request to adopt ITS).
3.2 Proposed TS Bases Changes TSTF-482, Rev 0, revised the LCO 3.0.6 Bases from "LCO 3.0.6 establishes an exception to LCO 3.0.2 for support systems that have an LCO specified in the Technical Specifications (TS)"
to "LCO 3.0.6 establishes an exception to LCO 3.0.2 for supported systems that have a support system LCO specified in the Technical Specifications (TS)." In addition, two editorial corrections are made to the LCO 3.0.6 Bases to make the sentences grammatically correct.
3.3
NRC Staff Evaluation
TSTF-482, Rev 0, was approved by the NRC on December 6, 2005, and modifies the Bases for LCO 3.0.6. LCO 3.0.6 states, "When a supported system LCO is not met solely due to a support system LCO not being met, the Conditions and Required Actions associated with this supported system are not required to be entered. Only the support system LCO ACTIONS are required to be entered. This is an exception to LCO 3.0.2 for the supported system." However, the LCO 3.0.6 Bases states "LCO 3.0.6 establishes an exception to LCO 3.0.2 for support Enclosure systems that have an LCO specified in the TS." The Bases also do not specify that this is only true if the support system has an LCO in the TS. This is inconsistent with the Specification and incorrect. LCO 3.0.2 states that when an LCO is not met, the Conditions and Required Actions must be entered. LCO 3.0.6 requires entering the Conditions and Required Actions for support systems when those support systems have an LCO in the TS. This change makes the Bases consistent with the Specifications.
The proposed changes described in TSTF-482, Rev 0, have been incorporated into Revision 3.1 of NUREG-1431, and all future changes to the Bases will be controlled in accordance with the program requirements of ITS Section 5.5.10, TS Bases Control Program. This program allows licensee to make changes to the Bases without prior Nuclear Regulatory Commission (NRC) approval provided that the change do not require either of the following:
- 1. A change in the TS incorporated in the license or
- 2. A change to the updated FSAR or Bases that requires NRC approval pursuant to 10 CFR 50.59, changes, tests and experiments.
Since the above changes do not affect the TS nor require prior NRC approval, the staff concludes that the proposed changes to the BVPS ITS Bases are acceptable.
4.0 CONCLUSION
The staff has reviewed the licensees submittals and supporting documentation. Based on the above evaluation the staff has concluded that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
