STATE OF MicTrGAN DEPARTMENT OF ENVIRONMENTAL QUALITY 9 KALAMAZOO DISTRICT OrFIcE e A JENNIFER M. GRANHOLM STEVEN E. CHESTER GOVERNOR DIRECTOR November 9, 2005 Mr. Eric Dehn, Environmental Coordinator Consumers Energy Company-Palisades Power Plant 27780 Blue Star Memorial Covert, Michigan 49043

Dear Mr. Dehn:

SUBJECT:

National Pollutant Discharge Elimination System (NPDES)

Permit No. M10001457 Designated Name: CECO-Palisades Power PIt It has come to the attention of the Department of Environmental Quality (DEQ) that the EPA's ECHO (Enforcement & Compliance History Online) Database has several noncompliances listed for Palisades Power Plant. The database lists several of these violations as non-receipt of DMR data as well as some other permit violations in prior years. The problem is with the uplink of DMR data to the EPA Database resulting in erroneous non-compliant violations.

Please disregard the violations on the ECHO database. I have personally investigated this and have determined that these reported violations on the ECHO database are erroneous. I have filed a complaint with the EPA to have the violations removed and the facility returned to compliance.

If you have any questions, please contact me at the number below.

Sincerely, Marcus J. Tironi, P.E.
