SUMMARY
OF NOVEMBER 1, 2005, MEETING TO DISCUSS PROPOSED PART 50 LICENSE AMENDMENT REQUEST FOR DRY STORAGE OF SPENT FUEL On November 1, 2005, the Nuclear Regulatory Commission (NRC) met with Duke to discuss the need for a license amendment request (LAR) to incorporate technical specifications into the Oconee Part 50 license (of Title 10 of the Code of Federal Regulations (10 CFR)) to facilitate loading and handling of Part-72-licensed casks in the spent fuel pools. Enclosure 1 is a list of the attendees. Enclosure 2 is the handouts provided by Duke during the meeting.
In its presentation, Duke described the need for an LAR based on a review of RIS 2005-05 and the dry storage systems in use at Oconee. Duke determined that its cask systems relied on a soluble boron credit to maintain subcriticality during fuel loading and handling in the moderated spent fuel pool environment. Duke determined that its spent fuel licensing basis required it to maintain fuel in a subcritical condition without a soluble boron credit. Therefore, Duke determined that it needs a license amendment to credit fuel burnup and load fuel into the dry-cask storage systems.
Duke presented the approach it is currently taking to perform the necessary criticality calculations. Duke emphasized that the criticality analysis methodologies being used to perform the evaluation are very similar to those methodologies reviewed and approved by the NRC for licensing the McGuire and Oconee spent fuel pools. Duke committed to identifying any deviations from the previously approved methodologies and providing a technical basis in the LAR. In addition, Duke indicated that its criticality analyses will address all current and previously loaded spent fuel canisters and will conform to current NRC expectations for soluble boron credit under 10 CFR Part 50.
Duke is planning to provide the LAR by March 1, 2006, and is requesting NRC approval by June 1, 2006. The NRC staff was able to identify a number of minor issues that Duke plans to
Duke address up front in the LAR to minimize the need for additional staff review time and requests for additional information. The NRC indicated that if Duke follows the guidance provided during the meeting, the requested approval date could likely be achieved.
