Duke Energy Corporation Catawba Nuclear Station, Unit 2 Docket Number 50-414 Oconee Nuclear Station, Unit 2 Docket Number 50-270 Request to use a later Edition and Addenda of the ASME Boiler and Pressure Vessel Code, Section Xl for Inservice Inspection in accordance with 10 CFR 50.55a(g)(4)(iv)
In accordance with the guidance provided in NRC Regulatory Issue Summary (RIS) 2004-12, dated July 28, 2004, Duke Energy Corporation hereby requests NRC approval to use selected portions of the ASME Boiler and Pressure Vessel Code, Section Xl, 1998 Edition with the 2000 Addenda, subject to modifications and limitations specified in 10CFR50.55a(b)(2), in lieu of the 1989 Edition and the 1992 Edition with the 1992 Addenda, as detailed in this request.
As noted in the NRC Regulatory Issue Summary 2004-12, licensees seeking to use later editions and addenda of the ASME Code,Section XI, pursuant to 10CFR50.55a(f)(4)(iv) or 10CFR50.55a(g)(4)(iv), are not required to seek relief pursuant to 10CFR50.55a(a)(3), 10CFR50.55a(f)(5)(iv) or 10CFR50.55a(g)(5)(iv). The NRC Regulatory Issue Summary 2004-12 also notes that the regulations do not specify when a licensee must submit a letter requesting approval to use later editions and addenda of the Code, only that the letter must be submitted before using the proposed later Code edition and addenda. Therefore, Duke Energy Corporation plans to begin updating procedures using proposed later Code edition and addenda upon submittal of this letter.
- 1. Approval is requested to use selected portions of the ASME Boiler and Pressure Vessel Code, Section Xl, 1998 Edition with the 1999 and 2000 Addenda, in lieu of the 1992 Edition with the 1992 Addenda, for Category L-A, Item L1.11 and L1.12 examinations. This request is limited to Oconee Unit 2 for the duration of Containment Inservice Inspection Interval 1, currently scheduled to end on September 9, 2006.

Approval is requested to use selected portions of the ASME Boiler and Pressure Vessel Code, Section Xl, 1998 Edition with the 1999 and 2000 Addenda, in lieu of the 1989 Edition, for the remainder of the Catawba Unit 2 Inservice Inspection Interval 2 (Class 1, 2, and 3 Components and Component Supports), currently scheduled to end on August 19, 2006.
The requested portions of the 1998 Edition with the 1999 and 2000 Addenda to be used, as well as a listing of applicable related requirements that will be met, is provided in Table 1, which is attached.

9 The later Code Edition and Addenda requires fewer welded attachments to be examined. Because the number of completed examinations performed using the 1989 Edition have exceeded the number required using the later Edition and Addenda, no more welded attachments are required to be examined.
As such, there are no related requirements to be met.
