COMMENT LETTER NUMBER 5 - NRC STAFF COMMENTS ON NEI 04-01, REVISION D, DRAFT GUIDELINE FOR COMBINED LICENSE APPLICANTS UNDER 10 CFR PART 52

Dear Mr. Bell:

By letter dated December 21, 2004, NEI submitted NEI 04-01 to facilitate the discussion with the U.S. Nuclear Regulatory Commission (NRC) concerning the information needed to evaluate a combined license application (ADAMS Accession Number ML050110295). Enclosed is a table (ADAMS Accession No. ML052240049) which provides additional NRC staff first-round comments on portions of NEI 04-01.

This is the last of five comment letters provided to NEI on NEI 04-01. Twenty-five separate NRC sections in both the Offices of Nuclear Reactor Regulation and Nuclear Security and Incident Response have reviewed NEI 04-01 and participated in six public meetings between February 2005 and July 2005. The NRC has provided a total of 252 comments on NEI 04-01.

Each comment has been numbered such that the NRC can track its resolution. The comments have been segregated into either comments the staff believes are needed to make the guidance reflective of NRC regulations and guidance or suggested changes to improve the guidance.

The comments should be inclusive of all the technical issues discussed in the NEI 04-01 public meetings (including separate public meetings on quality assurance and radiation protection).

However, you are encouraged to provide NRC feedback on issues that were raised during the meetings that you believe were not raised in NRC comments. In addition, the NRC Office of the General Counsel has not participated in this initial review of NEI 04-01 and may provide additional comments if and when NEI seeks endorsement of NEI 04-01 by the NRC.

At the July 2005 NEI 04-01 public meeting, you expressed an interest in having additional public meetings in Fall 2005 to discuss a revised version of NEI 04-01. In addition, you said that NEI would respond to NRC comments on NEI 04-01. I look forward to participating in future public meetings and in receiving NEIs responses to NRC comments on the guidance needed to develop combined license applications.
