On May 24, 2005, contraband was found during a routine search while an employee (contractor) was processing into the protected area. The Security Officer stationed at the protected area entrance viewed the x-ray machine results and determined that the employee had what appeared to be contraband (a handgun). The employee was detained and the handgun confiscated. Security Supervision was notified and employee's unescorted access was revoked. The employee and the handgun never entered the protected area. The cause of this incident was personnel error on the part of the employee. The employee had unescorted access to the protected area and had completed training that specifically identified what constituted contraband and that contraband was prohibited in the protected area. The employee was not allowed to enter the protected area. The employee is no longer employed at the Catawba Nuclear Station.

It was determined from an interview with the employee that there was no malevolent intent to deliver prohibited items into the Catawba protective area. At no time was there a threat to the safety of the station.

BACKGROUND Catawba Nuclear Station Units 1 and 2 are Westinghouse Pressurized Water Reactors [EIIS: RCT]. At the time this issue was identified, Unit 1 and Unit 2 were operating in Mode 1, Power Operation. This event is reportable per 10CFR 73.71(b)(1) and Appendix G(I)(d).

10 CFR 73.71(b)(1) contains the following requirements:

"Each licensee subject to the provisions of §§ 73.20, 73.37, 73.50, 73.51, 73.55, 73.60, or 73.67 shall notify the NRC Operations Center within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> of discovery of the safeguards events described in paragraph I(a)(1) of appendix G to this part. Licensees subject to the provisions of §§ 73.20, 73.37, 73.50, 73.51, 73.55, 73.60, or each licensee possessing strategic special nuclear material and subject to § 73.67(d) shall notify the NRC Operations Center within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> after discovery of the safeguards events described in paragraphs I(a)(2), (a)(3), (b), and (c) of appendix G to this part. Licensees subject to the provisions of §§ 73.20, 73.37, 73.50, 73.51, 73.55, or 73.60 shall notify the NRC Operations Center within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> after discovery of the safeguards events described in paragraph I(d) of appendix G to this part."

Paragraph I(d) of Appendix G to 10 CFR 73 requires reporting of security events within one (1) hour that meet the following criteria:

"The actual or attempted introduction of contraband into a protected area, material access area, vital area, or transport."

The regulation does not describe what an attempt consists of, however, some clarification can be found in the regulatory guide endorsed by this regulation, Regulatory Guide 5.62, Revision 1, dated November 1987. Regulatory Guide 5.62, Revision 1, Section C.2.2, "Examples of Safeguards Events To Be Reported Within 1 Hour," item 23 adds the following clarification of Appendix G I(d) as follows:

"Discovery of the actual or attempted introduction into or possession within the protected area, material access area, or vital area of unauthorized weapons, explosives, or incendiary devices. (Paragraph I (d) of Appendix G) There are no compensatory measures that would preclude reporting this event within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />. If an actual introduction of contraband is made, steps should be taken to correct NRC FORM 366A (1-2001)

The discovery of vehicular emergency equipment such as safety flares during entrance searches need not be reported or logged."

EVENT DESCRIPTION The following is a chronology of the security event reported by Catawba Nuclear Station to the NRC Operations Center via the Emergency Notification System on 5/24/2005.

05/24/2005 An employee (contractor vendor) entered the search lobby of the Protected Area Portal (PAP). The individual placed personnel items on an x-ray machine as required.

05/24/2005 The Security Officer stationed at the PAP entrance viewed the x-ray machine results and determined that the employee had what appeared to be contraband (a handgun).

The employee was detained and the handgun confiscated.

05/24/2005 Security Supervision was notified and employee's unescorted access was revoked. No contraband entered the protected area. The required notifications were made.

CAUSAL FACTORS The cause of this incident was personnel error on the part of the employee. The employee had unescorted access to the protected area and had completed training that specifically identified what constituted contraband and that contraband was prohibited in the protected area.

Discussions were held with the employee and Security Personnel.

Catawba Security personnel determined from the interview that the employee had no malevolent intent to deliver prohibited items into the Catawba protective area. At no time was there a threat to the safety of the station. The employee had placed the handgun in a personnel bag at their home due to visitors. The employee had come to work with the bag and forgot that the handgun was inside.

1. The employee involved in this incident is no longer employed at the Catawba Nuclear Station.

Planned:

There are no planned corrective actions in response to this event.

There are no NRC commitments contained in this LER.

SAFETY ANALYSIS, In this event, the search process established at Catawba for entry into the protected area performed as designed and identified the contraband prior to entry into the protected area.

This event did not result in any uncontrolled releases of radioactive material, personnel injuries, or radiation over exposure. The health and safety of the public were not affected by this event.

ADDITIONAL INFORMATION A review of Catawba events over the previous three (3) years did not identify any previous similar events. Therefore, this is not a recurring event.
