Withdrawal of Exelon/AmerGen License Amendment Request Related to Administrative Controls Incorporating Requirements for Control Room Envelope Program Integrity

Reference:

Exelon/AmerGen letter to NRC, dated November 29, 2004, "Exelon/AmerGen Request for Amendment to Technical Specifications Administrative Controls to Incorporate Requirement for Control Room Envelope Integrity Program" In the referenced letter, Exelon/AmerGen requested an amendment to incorporate Technical Specification administrative program requirements for control room habitability at each of the Exelon/AmerGen operating plants .

In conference calls held on March 14, 2005 and June 7, 2005, between Exelon/AmerGen and the NRC, several issues were discussed regarding the proposed amendment request. During these discussions, A was identified that the submittal did not disposition industry-generic issues subject that are the of on-going discussions between the NRC, the Nuclear Energy Institute (NEI) Control Room Habitability Task Force, and the industry Technical Specifications Task Force (TSTF). The specific generic issues discussed included providing specific criteria for tracer gas retesting, proposing a specific frequency of periodic tracer gas testing, and addressing the adequacy of differential pressure testing . Additionally, the proposed amendment request did not propose any Technical Specification limiting conditions for operation and surveillance requirements for the control room envelope boundary . Therefore, it is premature at this time to proceed with the proposed amendment request and Exelon/AmerGen hereby withdraws the referenced license amendment request.

Exelon/AmerGen continues to actively support the TSTF and the NEI Control Room Habitability Task Force in working with the NRC to obtain a mutually acceptable resolution on this important issue. In that light, Exelon/AmerGen will evaluate this submittal with respect to the elements contained in TSTF traveler-448 (TSTF-448), and resubmit a proposed license amendment request based on this evaluation within 90 days following NRC approval of TSTF-448 .

Regulatory commitments as a result of this submittal are identified in Attachment 1 .
