CLINTON POWER STATION, UNIT 1, OYSTER CREEK GENERATING STATION, AND THREE MILE ISLAND NUCLEAR STATION, UNIT 1, - INDIRECT LICENSE TRANSFER APPLICATIONS (TAC NOS. MC6329, MC6330, AND MC6331)
Dear Mr. Crane:
This is in regard to your letter dated March 3, 2005, in which AmerGen Energy Company, LLC (AmerGen) requested, to the extent necessary, the consent of the U.S. Nuclear Regulatory Commission (NRC) under Section 50.80 of Title 10 of the Code of Federal Regulations (10 CFR) to the indirect transfer of the licenses for Clinton Power Station, Unit 1, Oyster Creek Generating Station, and Three Mile Island Nuclear Station, Unit 1. The request for the license transfer approvals is related to the pending merger between Exelon Corporation, AmerGens indirect parent company, and Public Service Enterprise Group.
The NRC staff has performed a threshold review of the facts and circumstances set forth in your letter, and has considered how the merger will be implemented as described in the relevant Securities and Exchange Commission filings and the final structure of the merged entities. The staff has concluded that no NRC indirect license transfer approvals are required under 10 CFR 50.80 with respect to the licenses held by AmerGen for the subject plants.
This letter documents the conclusion of NRC activities related to the indirect license transfer requests for the subject plants.
