Gentlemen:

By letter dated August 23, 2004, Nine Mile Point Nuclear Station, LLC (NMPNS), submitted the notification of the irradiated fuel management plan for Nine Mile Point Unit 1 in accordance with 10 CFR 50.54(bb).

By letter dated February 11, 2005, the NRC requested additional information regarding the irradiated fuel management plan. NMPNS responses to this request for additional information, except for item (4), were provided by letter dated May 12, 2005.

Per discussions with the NRC Staff on May 12, 2005, the NMPNS response to item (4) is provided in Attachment 1.

ATTACHMENT 1 Nine Mile Point Unit 1 Response to NRC Request for Additional Information (RAI)

Regarding Irradiated Fuel Management Plan per 10 CFR 50.54(bb)

The requests are repeated below, followed by the Nine Mile Point Nuclear Station (NMPNS) response to item (4). Responses to items (1), (2), (3) and (5) were previously provided in NMPNS letter NMPIL 1951 dated May 12, 2005.

RAI For the NRC to evaluate and provide preliminary approval of the NMPJ spentfuel management andfiunding program, the licensee needs to provide supplemental information to include:

(1)

The estimated cost to isolate the spent fuel pool and fiel handling systems, or the cost to construct an independent spent fuel storage installation; (2)

The estimated annual cost for the operation of the selected option (wet or dry storage or a combination of the two) until the Department of Energy (DOE) takes possession of the fitel; (3)

The estimated cost for the preparation, packaging, and shipping of the fiel to DOE; (4)

The estimated cost to decommission the spentfiuel storage facility; and (5)

A brief discussion of each of the areas identified above and the estimated time periods for these activities.

NMPNS Response (4)

The Nine Mile Point Unit 1 (NMP1) Irradiated Fuel Management Plan, which is premised on cessation of NMP1 operations at the end of the current operating license, does not currently consider construction of an independent dry spent fuel storage facility.

Therefore, it is planned that the spent fuel will remain in the spent fuel pool until appropriate shipments are made to the Department of Energy (DOE).

The estimated cost to decommission the spent fuel pool, which is considered part of the overall decommissioning scope in terminating the 10 CFR Part 50 license, is approximately $48 million in 2005 dollars. In accordance with the proposed decommissioning scenario, this cost would occur before the final radiation surveys necessary to satisfy the conditions of 10 CFR 50.82(a)(I 1). Most of this cost would be incurred by or during 2066, prior to 10 CFR Part 50 license termination.
