Nine Mile Point Unit I Docket No. 50-220 License No. DPR-63 Clarification of Core Shroud Support Weld H9 Inspection Plan Commitment Change for Refueling Outage (RFO) 18 Gentlemen:

By letter dated August 2, 2001, Niagara Mohawk Power Corporation, the former licensee, submitted the results of the H9 weld inspection and associated flaw evaluation and the proposed reinspection plan for the weld to the NRC for review. The flaw evaluation and proposed reinspection plan were accepted by the NRC in its letter and safety evaluation (SE) dated October 31, 2001. For the H9 weld, the reinspection plan included a volumetric inspection during RFO17 using ultrasonic testing methods. Subsequently, in a letter dated December 13, 2002, Nine Mile Point Nuclear Station, LLC (NMPNS), requested NRC approval of an extension allowing the H9 weld reinspection to be completed during RFO18 instead of RFO17. The NRC staff reviewed the extension request and, by letter and SE dated March 20, 2003, approved the extension. By letter dated January 14,2005, NMPNS requested NRC approval to modify the H9 weld locations to be inspected from those previously approved by the NRC. With the January 14, 2005 submittal, NMPNS proposed to substitute inspection of the H9 weld at the NID nozzle for the previously approved NIA location.

Subsequent to the January 14, 2005, letter, the proposed change to the H9 reinspection scope was reviewed as a commitment change utilizing NEI 99-04, "Guidelines for Managing NRC Commitment Changes," as endorsed by NRC Regulatory Issue Summary 2000-17, "Managing Regulatory Commitments Made by Power Reactor Licensees to the NRC Staff." Through application of the NEI 99-04 process, it was determined while prior NRC notification of the inspection location change was required, NRC approval was not.

Page 2 NMPIL 1934 Therefore, the January 14, 2005, letter discussing the proposed revision to the H9 weld reinspection locations should be considered notification of NMPNS' commitment change. NRC review and approval of this commitment change is not requested.
