I am aware of such NRC requirements. We have worked together long enough for you to know that no one person, except the Governor, represents the official position of the State of New Jersey. These comments are germain to Control Room Habitability, or lack thereof, at Oyster Creek, and can be docketed as such.

NRC reviewers are considering your e-mail and the licensee's 12/9/04 and 12/13/04 letters. I shall get back to you later.

Meanwhile, I am advising you that your e-mails and my responses would be docketed and made public in accordance with applicable Federal and NRC requirements, unless certain conditions are met such that they qualify to be withheld from public disclosure. Please verify that you are aware of such NRC requirements. In addition, please advise if your e-mails convey official New Jersey positions (you did use your title in them), or purely personal opinion. If you do not desire that your e-mails be docketed and put in the the public domain, please consider other means of communication.

On June 12, 2003, the NRC issued NRC Generic Letter 2003-01 (letter) concerning nuclear power plant control room habitability. The letter required a response within 180 days to confirm that the facility control room meets applicable regulatory requirements. The letter also requested a response within 60 days if the information could not be obtained outlining an alternative course of action. On December 9, 2003, AmerGen committed to submit a license amendment request by December 31, 2004 that would help to confirm that the facility control room meets applicable regulatory requirements. On December 13, 2004 AmerGen sought permission to submit the license amendment March 31, 2005 that would help confirm that the facility control room meets applicable regulatory requirements.

Here we are 2 years later, without any response, one way or another, to the letter. Most importantly, the basic safety issue raised in the letter has not been put to rest. Not only has AmerGen not followed the directions in the letter, they ignored it. The NRC continues to

tolerate this without any consequence to the licensee. No penalty, enforcement, color, nothing! I don't know if pointing this out will accomplish anything but the NRC should be aware that we are aware of the lack of concern shown by the NRC concerning staying alive in the control room when an accident occurs!

We oppose any more NRC delays with this safety issue.
