November 10, 2004 Mr. Garry L. Randolph Vice President and Chief Nuclear Officer Union Electric Company Post Office Box 620 Fulton, MO 65251

SUBJECT:

CALLAWAY PLANT, UNIT 1 - WITHDRAWAL OF RELIEF REQUEST TO EXTEND SECOND INSERVICE INSPECTION PROGRAM 10-YEAR INTERVAL (TAC NO. MC3764)

Dear Mr. Randolph:

By letter dated July 6, 2004 (ULNRC-05024), Union Electric Company requested relief from 10 CFR 50.55a to extend the current 10-year interval for the 10-year inservice inspection program to accommodate plans to replace the steam generators at the Callaway Plant in Refueling Outage 14, which is scheduled for the Fall of 2005. In the letter dated October 18, 2004 (ULNRC-05064), this request was withdrawn. In the letter, it was stated that Union Electric Company intended to take the one-year extension for the 10-year interval which is allowed by 10 CFR 50.55a and the American Society of Mechanical Engineers Boiler and Pressure Vessel Code of record for the Callaway Plant. Any further requests for relief, if required, would be submited on a case-by-case basis.

Based on the letter of October 18, 2004, we have closed out our review of the above relief request and TAC No. MC3764 is closed.

Sincerely,

/RA/
