PALISADES NUCLEAR PLANT - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. MC3120)

Dear Mr. Malone:

By letter to the U.S. Nuclear Regulatory Commission (the Commission) dated May 10, 2004, supplemented by letter dated June 22, 2004, you applied for an amendment to the Palisades Nuclear Plant, Facility Operating License No. DPR-20. The proposed change would have replaced the current License Condition 2.C.(5) and its corresponding Table 2.C.(5) with a new License Condition. The new License Condition would have delayed performance of Technical Specification (TS) surveillance requirement (SR) 3.1.4.3 for control rod drive (CRD) 19 until the fall 2004 refueling outage. However, the new condition would have required that performance of TS SR 3.1.4.3 for CRD 19 resume, at the SRs specified frequency, no later than September 30, 2004. Only CRD 19 would have been affected by the change.

However, equipment issues not related to the amendment request later developed and necessitated reduction of reactor power. Surveillance of CRD 19 was then performed while the reactor was at reduced power. Therefore, by letter dated August 10, 2004, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION NUCLEAR MANAGEMENT COMPANY, LLC DOCKET NO. 50-255 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Nuclear Management Company, LLC (the licensee), to withdraw its May 10, 2004, application for proposed amendment to Facility Operating License No. DPR-20 for the Palisades Nuclear Plant located in Van Buren County, Michigan.

The proposed amendment would have replaced the current License Condition 2.C.(5) and its corresponding Table 2.C.(5) with a new License Condition. The new License Condition would have exempted control rod drive (CRD) 19 from performance of Technical Specification (TS) surveillance requirement (SR) 3.1.4.3 until the fall 2004 refueling outage. However, the new condition would have required that performance of TS SR 3.1.4.3 for CRD 19 resume, at the SRs specified frequency, no later than September 30, 2004. The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on May 21, 2004 (69 FR 29335).

However, equipment issues not related to the amendment request later developed and necessitated reduction of reactor power. Surveillance of CRD 19 was then performed while the reactor was at reduced power. Therefore, by letter dated August 10, 2004, the licensee withdrew the amendment request.
