SUMMARY
OF SEPTEMBER 2, 2004, MEETING WITH NUCLEAR MANAGEMENT COMPANY, LLC (NMC), REGARDING THE JUNE 25, 2004, POINT BEACH NUCLEAR PLANT EMERGENCY ACTION LEVEL (EAL)
CONVERSION SUBMITTAL (TAC NOS. MC3773 AND MC3774)
On September 2, 2004, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of NMC at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to facilitate discussion between NRC staff and NMC so the NRC staff could gather more information concerning NMCs June 25, 2004, Point Beach Emergency Action Level (EAL) conversion submittal. A list of attendees is provided as Enclosure 1.
During its acceptance review of the submittal, the NRC staff had identified instances where the proposed Point Beach EALs deviated/differed from the Nuclear Energy Institute (NEI) 99-01 EALs. The NRC staff sought clarification of the nature of these deviations/differences and whether the submittal contained deviations/differences in addition to those identified by the staff. During the meeting, NMC presented information that compared the proposed Point Beach EALs with the NEI 99-01 EALs (see Enclosure 2). Selected deviations/differences were identified and discussed, including examples of deviations from NEI 99-01 that had not been identified in the NMC submittal.
The NRC staff discussed its understanding of and comments regarding the submittal and the information presented by NMC. During the discussions, the NRC staff stated that deviations/differences from the NEI 99-01 EALs should have been clearly identified and justified/discussed in the submittal. The NRC staff discussions, however, do not constitute an NRC staff position. Furthermore, no regulatory decisions were made during the meeting.
The NRC staff also requested that NMC inform the NRC of a schedule for providing the NRC with a supplement to the original submittal. NMC did so on September 7, 2004, stating that October 8, 2004, was the planned submission date.
