Dear Ms. Curran:

This letter is in response to your August 13, 2004 letter to Antonio Fernández. In that letter you requested certain information related to the redacted physical security plan (PSP) for the Catawba Nuclear Station, which the NRC staff (Staff) has made available to you. You also requested copies of security-related Staff guidance documents. Although your requests were made outside the discovery process, in the interest of expediency, the Staff provides the following response.

The version of the PSP to which the Staff provided access was the version on file at the NRC at the time Duke Energy Corporations License Amendment Request was submitted. Licensees may revise their security plans without prior approval from the NRC as long as the revisions do not decrease the level of Safeguards effectiveness of the plan. 10 C.F.R. § 50.54(p)(2).

Therefore, Revision 15 was completed by Duke without filing the revision with the NRC. A redacted copy of Revision 15 will be made available to you by the Staff as soon as the Staff has made redactions consistent with the redactions made to the sections of the PSP to which you have previously been provided access. In addition, the dates of all revisions to the PSP are listed below:

Revision 09, April 26, 1999 (document reissued as a superseding document)

Revision 10, October 13, 1999 Revision 11, November 15, 1999 Revision 12, April 3, 2000 Revision 13, January 14, 2002 Revision 14, July 10, 2003 Revision 15, August 18, 2003 You also inquired about the reasons for several redactions to the PSP. Each section in question was redacted because the section related solely to protection of a specific vital area or target set other than the spent fuel pool. Therefore, the Staff determined that there was no need to know with regard to that information, as protection of areas other than the spent fuel pool is outside the scope of the current proceeding.

As to the regulatory guidance documents of which you requested copies, most of the documents are available through the NRCs Public Document Room (PDR). For access to the documents, please contact the PDR at pdr@nrc.gov or 301-415-4737. Three of the documents, NUREG-0508, NUREG-1329, and NUREG/CR-6190, have been withdrawn from the PDR. If you wish to have access to the withdrawn documents, please file a formal discovery request.
