SUBJECT:

YANKEE NUCLEAR POWER STATION - REVISION 13 TO THE SECURITY PLAN AND TERMINATION OF ORDER FOR INTERIM SAFEGUARDS AND SECURITY COMPENSATORY MEASURES FOR YANKEE ATOMIC ELECTRIC COMPANY (EA 02-077) (TAC NO. L52605)

Dear Mr. Kacich:

By letter dated June 19, 2003, you submitted to the NRC, Revision 13 to your security plan which revised the plan to reflect the transfer of all irradiated fuel from the spent fuel pool to the Independent Spent Fuel Storage Installation (ISFSI). You also stated that an evaluation of the change in accordance with 10 CFR 50.54(p) determined that it did not reduce the effectiveness of the plan and that it continues to meet the standards of 10 CFR 73.55 as applicable. We have reviewed the changes and have no comments at this time. Adequacy of the plan may be verified by inspection at a later date.

You also requested that the order dated May 23, 2003, containing compensatory measures for facilities under decommissioning, be withdrawn. The terms of this order were intended to remain in effect until all fuel and radioactive sources had been removed from the spent fuel pool at Yankee Nuclear Power Station. As of June 21, 2003, all fuel and Greater Than Class C waste had been transferred from the spent fuel pool to the ISFSI. Accordingly, as provided in Section III of the order, I hereby terminate the order. Yankee Nuclear Power Station shall continue to adhere to the terms of the October 16, 2002, order containing compensatory measures for ISFSIs as well as other terms and conditions of its license and the Commissions regulations.
