BROWNS FERRY NUCLEAR PLANT, UNIT 3 - APPROVAL TO USE THE 1995 EDITION THROUGH 1996 ADDENDA, SUBARTICLE IWA-2430, OF THE AMERICAN SOCIETY OF MECHANICAL ENGINEERS BOILER AND PRESSURE VESSEL CODE FOR INSPECTION INTERVALS (TAC NO. MC2075)

Dear Mr. Scalice:

By letter dated February 20, 2004, the Tennessee Valley Authority (TVA or the licensee) requested the U.S. Nuclear Regulatory Commissions (NRCs) approval to use Subarticle IWA-2430, Inspection Intervals, in its entirety, and all related requirements of the 1995 Edition through 1996 Addenda of the American Society of Mechanical Engineers Boiler and Pressure Vessel (ASME) Code, for the remainder of the Browns Ferry Nuclear Plant (BFN), Unit 3, second 10-year inservice inspection (ISI) interval. The current ASME Code of record for BFN Unit 3 is the 1989 Edition for the second 10-year interval, which will end on November 19, 2005.

The licensee stated that Subarticle IWA-2430 of the 1995 Edition, 1996 Addenda, of the ASME Code provides greater flexibility in extending and even overlapping ISI intervals.

Title 10 of the Code of Federal Regulations (10 CFR), Section 50.55a(g)(4)(iv), states that the inservice examination of components and system pressure tests may meet the requirements set forth in subsequent editions and addenda that are incorporated by reference in 10 CFR 50.55a(b), subject to the limitations and modifications listed therein and NRC approval.

Portions of the editions or addenda may be used provided that all related requirements of the respective editions and addenda are met. TVAs request to use Subarticle IWA-2430 in its entirety, and all related requirements of the 1995 Edition, 1996 Addenda, of the ASME Code associated with ISI interval schedules is approved pursuant to 10 CFR 50.55a(g)(4)(iv) for the remainder of the current ISI interval for Unit 3.
