EDWIN I. HATCH NUCLEAR PLANT, UNITS 1 AND 2 RE: REVIEW OF TECHNICAL SPECIFICATION REVISION TO PRIMARY CONTAINMENT LEAKAGE RATE TESTING PROGRAM (TAC NOS. MC1432 AND MC1433)

Dear Mr. Sumner:

By letter dated December 1, 2003 (NL-03-2353), you requested a license amendment to change the peak calculated post accident primary containment internal pressure, Pa, in section 5.5.12, Primary Containment Leakage Rate Testing Program, of the Unit 1 and 2 Technical Specifications. The change was proposed to support a 10 psi increase in the nominal Unit 1 and 2 reactor operating pressure needed to fully implement the Measurement Uncertainty Recapture Power Uprate (MURPU). The MURPU was issued by the Nuclear Regulatory Commission (NRC) in License Amendments 238/180, dated September 23, 2003. In your letter dated December 1, 2003, there was no requested completion date, so a normal one year review was scheduled. By letter dated January 23, 2004 (NL-04-0072), you stated that the license amendment was requested by May 2004, to allow for the full implementation of the MURPU during the low electrical demand period for the Southern Company.

Unfortunately, the NRC is unable to meet your request for an expedited review. The NRC technical staff is working on other planned and scheduled activities that make it impossible for us to revise our schedules to meet your needs.
