SUMMARY

OF MEETING ON DECEMBER 9, 2003, TO DISCUSS LICENSING ISSUES AND UPCOMING LICENSING ACTIVITIES On December 9, 2003, members of the U.S. Nuclear Regulatory Commission (NRC) staff met with Exelon Generation Company, LLC, and AmerGen Energy Company, LLC, representatives (the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, MD. The purpose of the meeting was to discuss licensing issues and upcoming licensing activities for the Exelon and AmerGen fleet of plants. The meeting was a Category 1 public meeting and the meeting notice was published on November 21, 2003. Enclosure 1 includes the list of attendees. The presentation slides used by the licensee are accessible in the Agencywide Documents Access and Management System (ADAMS) under ADAMS accession number ML033440348 and are included as Enclosure 2.

The licensee discussed the organizational structure of Exelon/AmerGen along with their regulatory strategy and schedule for submitting multi-plant submittals. Specifically, the licensee discussed the following:

  • Risk Informed Initiative 5b - The risk informed initiative involves relocation of Surveillance Test Intervals (STIs) from the technical specifications to an owner controlled document. The Limerick and Peach Bottom facilities will be the pilot plants. It is anticipated that a Limerick topical report with associated technical specification changes will be submitted in February 2004. The licensee will request staff approval of the Nuclear Energy Institute methodology along with the Boiling Water Reactor Owners Group Technical Specification Task Force 425 submittal.

The staff indicated this approach would conflict with the staffs goals of completing topical report reviews within 2 years and license amendment applications within 1 year.

It was recommended that the licensee work with the project manager to develop an acceptable schedule.

  • Elimination of Appendix B, Environmental Protection Plan - The licensee may propose elimination of Appendix B, Environmental Protection Plan, from the Technical Specifications. The licensee noted that some facilities were not licensed with an Appendix B.
  • Consolidated Line Item Improvement Process (CLIIP) Review Times - The licensee plans to submit license amendment changes to implement the CLIIP associated with limiting condition for operation 3.0.4 (Mode Changes). The licensee noted that the CLIIP process was established to accelerate the amendment process and questioned whether they should request and expect staff completion within 6 months as opposed to the staffs overall completion goal of 1 year for license amendment applications.

The staff will attempt to complete these submittals as requested.

  • Review Schedules - The licensee discussed the staffs procedures (i.e., Office Instruction LIC-101, License Amendment Review Procedures). LIC-101 contains Table 2, Guidance for Estimating Application Review Hours of Effort. Guidance within LIC-101 states that project managers will communicate the results of the planning process (i.e., the categorization of the application per Table 2, the estimated technical review staff-hours, and the completion times) to the licensee. The licensee stated that such information is not always provided and would be useful for their planning purposes.

The staff indicated that project managers are expected to provide such information within approximately 4-6 weeks following submittal. If such information has not been provided within approximately 8 weeks, the licensee should request it from the project managers.

Following the discussion of licensing topics affecting the Exelon fleet of plants, the participants broke up into two groups (Eastern Regional Operating Group and Midwest Regional Operating Group) to discuss the status of licensing actions that are currently under staff review and the schedules for the licensing issues that are planned for 2004.
