January 5, 2004 Mr. Lew W. Myers Chief Operating Officer FirstEnergy Nuclear Operating Company Davis-Besse Nuclear Power Station 5501 North State Route 2 Oak Harbor, OH 43449-9760

SUBJECT:

DAVIS-BESSE UNIT 1 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. MB3746)

Dear Mr. Myers:

By letter dated December 17, 2001, as supplemented by letter dated June 4, 2002, you applied for an amendment to the Davis-Besse Nuclear Power Station, Facility Operating License No.

NPF-3. The proposed change would have modified the facility technical specifications (TS) pertaining to TS 3/4.3.1, Reactor Protection System (RPS) Instrumentation, to delete an Action involving either reducing core thermal power and the high neutron flux reactor trip setpoint, or monitoring quadrant power tilt when an RPS channel is inoperable. Additionally, changes were proposed to the content and format of TS Tables 3.3-1 and 4.3-1 to enhance TS clarity. Subsequently, by letter dated November 26, 2003, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

Sincerely,

/RA/
