SUMMARY

OF DECEMBER 10, 2002, MEETING TO DISCUSS TORNADO MITIGATION On December 10, 2002, the Nuclear Regulatory Commission (NRC) met with Duke Energy (the licensee) to discuss the licensees June 7, 2002, submittal on tornado mitigation. Enclosure 1 is a list of the attendees. Enclosure 2 is an NRC memorandum dated November 7, 1983, Position on Use of Probabilistic Risk Assessment in Tornado Missile Protection Licensing Actions, that was provided to the licensee during the meeting. The June 7, 2002, submittal and the handouts provided by the licensee are accessible electronically from the Agencywide Documents Access and Management System (ADAMS) Public Electronic Reading Room on the internet at the NRC Web site, http://www.nrc.gov/reading-rm/adams/html. The accession number for the June 7, 2002, submittal is ML021710770, and the accession number for the handouts provided by the licensee is ML023450585.

Prior to the meeting, the NRC had sent questions to the licensee regarding the licensees probabistic risk assessment. The licensees handout entitled, Duke Responses to NRC Questions on the Oconee Nuclear Station Tornado Licensing Amendment Request, December 10, 2002, contained each question and a brief response in bullet format that was used for discussion during the meeting. The licensee committed to provide on the docket an expanded response to those questions that the NRC identifies.

The licensees basic approach to tornado mitigation is to modify the Standby Shutdown Facility (SSF) so that it can withstand the effects of a tornado and then use the SSF as the assured means of achieving safe shutdown. The NRC noted that the SSF is not single-failure proof and questioned whether this meets NRC requirements. The licensee stated that, for the Oconee facility, there is no requirement that the systems used to mitigate the effects of a tornado be single-failure proof. The NRC stated that it will relook at the requirements for Oconee tornado mitigation. The NRC also stated that it is still reviewing the deterministic evaluation contained in the licensees June 7, 2002, submittal and the NRC may have additional questions on this evaluation.
