Withdrawal of License Amendment Requests 97-0007, 97-0012, and 01-0005 (TAC Nos. MB11689, MA6094, and MB3281, respectively)

Ladies and Gentlemen:

By letters dated March 30, 2001, July 26, 1999, and October 9, 2001 (Serial Numbers 2664, 2583, and 2722, respectively), the FirstEnergy Nuclear Operating Company (FENOC) submitted applications (License Amendment Requests (LAR) 97-0007, 97-0012, and 01-0005, respectively) to amend the Davis-Besse Nuclear Power Station (DBNPS) Unit Number 1, Facility Operating License NPF-3, Appendix A, Technical Specifications. For the reasons discussed below, FENOC is withdrawing these three license amendment applications from the NRC.

The changes proposed by LAR 97-0007 involved increasing the surveillance interval for Surveillance Requirement (SR) 4.5.2.f of Technical Specification (TS) 3/4.5.2, Emergency Core Cooling Systems - ECCS Subsystems - Tavg > 280 'F. This SR involves performance of a vacuum leakage rate test of the watertight enclosure for Decay Heat Removal System valves DH-1 1 and DH-12. However, FENOC is currently considenng various options to improve the sealing capability of the watertight enclosure. Since any physical modification will result in a watertight enclosure that is different than that described in the supporting justification for this request, FENOC hereby withdraws LAR 97-0007.

The changes proposed by LAR 97-0012 involved TS 3/4.3.2.1, Safety Features Actuation System Instrumentation. The LAR included a proposed revision to the setpoint allowable values for the 59% and 90% undervoltage relays. By letter Serial Number 2666, dated August 14, 2000, FENOC requested the NRC staff to defer its processing of LAR 97-0012, until a revision was submitted to the NRC to increase the scope of the LAR. However, FENOC engineering has recently determined the setpoint calculations associated with the undervoltage relays will

Docket Number 50-346 License Number NPF-3 Serial Number 2823 Page 2 undergo further revision that will impact the changes proposed by the request. Accordingly, FENOC hereby withdraws LAR 97-0012.

The changes proposed by LAR 01-0005 primarily involved TS 3/4.3.2.2, Steam and Feedwater Rupture Control System Instrumentation. The main purpose of this LAR was to decrease the Channel Functional Test frequency from monthly to quarterly for the Steam and Feedwater Rupture Control System Instrumentation Channels, and to revise the setpoint allowable values accordingly. However, as a result of an October 2, 2002 telephone conference call held with the NRC staff regarding the setpoint calculation methodology, the associated calculations were reevaluated, and it was identified that a setpoint calculation will require revision by FENOC, impacting the changes proposed by the request. Accordingly, FENOC hereby withdraws LAR 01-0005.
