Dear Mr. Coutu:
The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed Amendment No. 162 to Facility Operating License No. DPR-43 for the Kewaunee Nuclear Power Plant (KNPP). This amendment revises the Technical Specifications (TS) in response to your application dated June 7, 2002, as supplemented August 20 and 29, 2002.
The amendment revises the KNPP TS for administrative changes: 1) Table of Contents,
- 2) Facility Operating License, 3) Section 1 - Definitions, 4), Section 2 - Safety Limits and Limiting Safety System Settings, 5) Section 5 - Design Features, and 6) Section 6 -
Administrative Controls. The administrative changes include capitalizing defined words, formatting section titles, renumbering pages and correcting miscellaneous grammar and punctuation errors.
A copy of the Safety Evaluation is also enclosed. The Notice of Issuance will be included in the Commission's next regular biweekly Federal Register notice.

- 1. The U.S. Nuclear Regulatory Commission (the Commission) has found that:
A. The application for amendment by Nuclear Management Company, LLC (NMC or the licensee), dated June 7, 2002, as supplemented August 20 and 29, 2002, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.
- 2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.C.(2) of Facility Operating License No. DPR-43 is hereby amended to read as follows:
(2) Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. , are hereby incorporated in the license. The licensees shall operate the facility in accordance with the Technical Specifications.
- 3. This license amendment is effective as of the date of its issuance, and is to be implemented within 30 days of the date of issuance.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATING TO AMENDMENT NO. TO FACILITY OPERATING LICENSE NO. DPR-43 NUCLEAR MANAGEMENT COMPANY, LLC KEWAUNEE NUCLEAR POWER PLANT DOCKET NO. 50-305
1.0 INTRODUCTION
By letter dated June 7, 2002, as supplemented August 20 and 29, 2002, Nuclear Management Company, LLC (NMC or licensee) submitted a request for an amendment change to the Technical Specifications (TSs) for the Kewaunee Nuclear Power Plant (KNPP). The proposed amendment would revise the KNPP TS for administrative changes: 1) Table of Contents, 2)
Facility Operating License, 3) Section 1 - Definitions, 4) Section 2 - Safety Limits and Limiting Safety System Settings, 5) Section 5 - Design Features, and 6) Section 6 - Administrative Controls. The administrative changes include capitalizing defined words, formatting section titles, renumbering pages and correcting miscellaneous grammar and punctuation errors. In addition, the licensee informed the U.S. Nuclear Regulatory Commission (NRC) staff of its intention to reformat TS Table of Contents, Facility Operating License, Section 1.0, Section 2.0, Section 5.0, and Section 6.0 using MicroSoft Word format.
The supplemental information dated August 20 and 29, 2002, contained clarifying information and did not change the scope of the June 7, 2002, application nor the initial no significant hazards consideration determination and did not expand the scope of the original Federal Register notice.
2.0 EVALUATION The licensee proposed administrative changes to TS Table of Contents, Facility Operating License, Section 1.0, Section 2.0, Section 5.0, and Section 6.0.
The proposed administrative changes for the Table of Contents are renumbering section pages.
In addition, another proposed administrative change for the Table of Contents page TS iv was to place Deleted for Section 6.14 in place of Post Accident Sampling and Monitoring. TS Section 6.14 was deleted via Amendment No. 160, dated January 16, 2002; however, the Table of Contents page TS iv was not submitted as part of Amendment No. 160. The proposed changes for the Facility Operating License are punctuation revisions. The proposed changes to Sections 1.0, 2.0, 5.0, and 6.0 are capitalizing defined words, formatting section titles, renumbering pages and correcting miscellaneous grammar and punctuation errors.
The NRC staff reviewed the proposed administrative changes to TS Table of Contents, Facility Operating License, Section 1.0, Section 2.0, Section 5.0, and Section 6.0. The proposed
administrative changes do not alter any technical requirements, intent of these specifications, or interpretation of these specifications. Therefore, the NRC staff finds the proposed changes acceptable.
In addition, the licensee informed the NRC of its intent to reformat TS Table of Contents, List of Tables, List of Figures, Facility Operating License, Section 1.0, Section 2.0, Section 5.0, and Section 6.0 using Microsoft Word format. The wordprocessing software change does not affect the content of TS Table of Contents, List of Tables, List of Figures, Facility Operating License, Section 1.0, Section 2.0, Section 5.0, and Section 6.0. The NRC staff does not object to the format change.
3.0 STATE CONSULTATION
In accordance with the Commissions regulations, the Wisconsin State official was notified of the proposed issuance of the amendment. The State official had no comments.
4.0 ENVIRONMENTAL CONSIDERATION
This amendment changes recordkeeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this amendment.
5.0 CONCLUSION
The NRC staff has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.
