TERMINATION OF REVIEW OF APPLICATIONS FOR TRANSFER OF OPERATING AUTHORITY UNDER FACILITY OPERATING LICENSES TO DUKE ENERGY NUCLEAR, LLC - (TAC NOS. MB2380, MB2381, MB2358, MB2359, MB2362, MB2363, MB2364, AND L23347)
Dear Mr. Tuckman:
Your letter of dated July 10, 2001, requested NRC approval to transfer operating authority of the subject nuclear stations from Duke Energy Corporation (DEC) to Duke Energy Nuclear, LLC, a wholly-owned subsidiary of DEC. On December 20, 2001, we issued Orders Approving the Transfer of Operating Authority for the three stations. The orders required that you inform us after you receive all the necessary regulatory approvals of this transfer of operating authority. In your letter of February 27, 2002, you told us that you have still have not received approval from the North Carolina Utilities Commission (NCUC).
We have decided to terminate our review of this activity at this time and close out TAC Nos.
MB2380, MB2381, MB2358, MB2359, MB2362, MB2363, MB2364, and L23347. Please contact us by letter when you have completed the appeal process and we will reinstate our review.
