Dear Mr. Ray:

The Commission has issued the enclosed Amendment No. 184 to Facility Operating License No. NPF-10 and Amendment No. 175 to Facility Operating License No. NPF-15 for San Onofre Nuclear Generating Station, Units 2 and 3, respectively. The amendments are in response to your application dated January 9, 2002, and revise Technical Specification 5.4, Technical Specifications (TS) Bases Control, pursuant to the revised regulations in Title 10, Code of Federal Regulations, (10 CFR) Section 50.59 which eliminated the term "unreviewed safety question."

A copy of our related Safety Evaluation is also enclosed. The Notice of Issuance will be included in the Commission's next biweekly Federal Register notice.

1. The Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment by Southern California Edison Company, et al.,

(SCE or the licensee), dated January 9, 2002, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.C(2) of Facility Operating License No. NPF-10 is hereby amended to read as follows:

(2) Technical Specifications The Technical Specifications contained in Appendix A and the Environmental Protection Plan contained in Appendix B, as revised through Amendment No. 184, are hereby incorporated in the license. Southern California Edison Company shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

3. This license amendment is effective as of the date of its issuance and shall be implemented within 60 days of issuance.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 184 TO FACILITY OPERATING LICENSE NO. NPF-10 AND AMENDMENT NO. 175 TO FACILITY OPERATING LICENSE NO. NPF-15 SOUTHERN CALIFORNIA EDISON COMPANY SAN DIEGO GAS AND ELECTRIC COMPANY THE CITY OF RIVERSIDE, CALIFORNIA THE CITY OF ANAHEIM, CALIFORNIA SAN ONOFRE NUCLEAR GENERATING STATION, UNITS 2 AND 3 DOCKET NOS. 50-361 AND 50-362

1.0 INTRODUCTION

By application dated January 9, 2002, Southern California Edison Company, et al., (SCE or the licensee), requested changes to the Technical Specifications for San Onofre Nuclear Generating Station (SONGS), Units 2 and 3. The proposed changes would revise Technical Specification (TS) 5.4, Technical Specification (TS) Bases Control. Specifically, TS 5.4.2 and TS 5.4.2.b would be revised to replace the word "involve" with "require," and delete the term "unreviewed safety question," respectively. The proposed changes are pursuant to the revised regulations in Title 10, Code of Federal Regulations (10 CFR) Section 50.59, which eliminated the term "unreviewed safety question."

2.0 BACKGROUND

Section 10 CFR 50.59 establishes the conditions under which licensees may make changes to the facility or procedures and conduct tests or experiments without prior NRC approval.

In 1999, the NRC revised its regulation (Federal Register, Vol. 64, No.191, dated October 4, 1999) controlling changes, tests and experiments performed by nuclear plant licensees. The rule changes clarified the specific types of changes, tests, and experiments conducted at a licensed facility that require evaluation, and revised the criteria that licensees must use to determine when NRC approval is needed before such changes, tests, or experiments can be implemented. The revised regulation eliminated the term "unreviewed safety question," added definitions for terms that have been subject to differing interpretations, and reorganized the rule language for clarity.

3.0 EVALUATION Presently, SONGS, Units 2 and 3, TS 5.4.2 allow the licensee to make changes to the TS Bases without NRC approval provided they do not involve "a change to the updated FSAR or Bases that involves an unreviewed safety question as defined in 10 CFR 50.59." With the revisions to 10 CFR 50.59, the term unreviewed safety question" was eliminated. The licensee proposed changes to TS 5.4.2 to reflect the changes to 10 CFR 50.59.

The proposed changes to TS 5.4.2 do not have any impact on Final Safety Analysis Report accident analyses or other TS requirements. Changes to TS Bases will continue to be subject to appropriate administrative controls and 10 CFR 50.59 requirements. Thus, the proposed changes are administrative in nature and consistent with the revised 10 CFR 50.59. Therefore, the proposed changes are acceptable.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the California State official was notified of the proposed issuance of the amendments. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendments relate to changes in record keeping, reporting, or administrative procedures or requirements. Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
