50-369 and 50-370 Request for Withdrawal of License Amendment TAC Numbers MB1261 and MB1262 By letter dated February 14, 2001, as supplemented by letter dated May 30, 2001, Duke Energy submitted a license amendment request (LAR) to revise Technical Specification (TS)

TS 3.3.2, Engineered Safety Feature Actuation System Instrumentation, TS 3.4.3, Reactor Coolant System Pressure and Temperature Limits, and TS 3.4.12, Low Temperature Overpressure Protection System.

The NRC issued a request for additional information (RAI) associated with this LAR by letter dated August 1, 2001.

One of the questions in this RAI involves WCAP-15315, which proposes to eliminate the reactor vessel flange region temperature requirement from Table 1 of 10 CFR 50 Appendix G.

This WCAP has not been approved by the NRC due to technical issues being resolved by Westinghouse.

An exemption request, pursuant to 10 CFR 50.12, to relax the reactor vessel flange region temperature requirement from 10 CFR 50 Appendix G requirements was included with the referenced LAR.

The NRC has stated that it does not plan to approve this LAR until after its approval of the referenced WCAP.

Due to the extended schedule for resolving technical issues and approving this WCAP, Duke Energy hereby withdraws this LAR, pursuant to 10 CFR 2.106.

Duke Energy plans to re-instate this LAR at an appropriate time by referencing material previously submitted.

A response to the referenced RAI will also be submitted at that time.
