FPL 10 CFR 26.717 L-2010-040 February 25, 2010 U.S Nuclear Regulatory Commission Attn.: Document Control Desk Washington, D.C. 20555 Re: Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-251 2009 Annual Fitness for Duty Performance Report Attached is the Annual Fitness for Duty Performance Report for the period of January 1, 2009, through December 31, 2009, for Turkey Point Units 3 and 4, as required by 10 CFR 26.717(e).

The Turkey Point Fitness for Duty Program uses a random testing rate of at least 50%. contains the Fitness for Duty Program performance data, as well as, a list of events reported and a summary of any management actions taken. Attachment 2 contains the Annual Fatigue Management Summary as required by 10 CFR Part 26.203(e).

By test type, fourteen (14) pre-access tests Were positive, two (2) for cause - observed behavior tests were positive and three (3) random tests were positive.

Follow-Up Test One hundred follow-up tests were conducted with no positive test results reported.

Pre-Access Positive Tests Six (6) Initial contractor individuals tested positive for Marijuana. Four (4) Reinstatement contractor individuals tested positive for Marijuana. One (1) initial contractor individual tested positive for Cocaine. Two (2) initial Licensee individuals tested positive for Marijuana. These individuals were denied access. One (1) licensee individual refused to test after providing a specimen with no temperature. This individual was permanently denied access.

One (1) contractor employee tested positive for Alcohol. These individuals were denied access. One (1) contractor employee refused to test after providing a specimen with no temperature. This individual was permanently denied access.

For Cause Positive Tests Two (2) contractor employees tested positive for Alcohol, both were for observed behavior. These individuals were denied access.

Additional Comments

1. There were two (2) possible subversion attempts during the 2009 reporting period. A specimen with no temperature was submitted on a pre-access test and another no temperature was submitted on a random test. Both individual's refused to provide an observed specimen. The information is listed under Pre-Access and Random positive tests above.
2. For the 2009 reporting period, all blind specimens submitted to Turkey Point Nuclear Plant HHS-certified laboratory yielded expected results.

Reportable Events Turkey Point Nuclear Plant had one (1) Twenty-four Hour Reportable event on 22 January 2009. A contractor supervisor tested positive for alcohol based on a For-Cause test, observed behavior. Access was denied.
