Beaver Valley Power Station, Unit No. 1 Docket No. 50-334, License No. DPR-66 Withdrawal of License Amendment Request 297 This letter withdraws License Amendment Request 297 including the associated exemption requests, which were submitted by FirstEnergy Nuclear Operating Company (FENOC) letter L-02-004, dated January 25, 2002. License Amendment Request (LAR) 297 would have revised the Beaver Valley Power Station Unit No. 1 Technical Specifications which specify the reactor coolant system heatup/cooldown curves, the power-operated relief valve setpoint and the overpressure protection system enable temperature based upon use of the Master Curve Methodology. The LAR also contained an exemption request from certain requirements of 10 CFR 50.60, "Acceptance Criteria for Fracture Prevention Measures for Lightwater Nuclear Power Reactors for Normal Operation," 10 CFR 50.61, "Fracture Toughness Requirements for Protection Against Pressurized Thermal Shock Events," 10 CFR 50.54, "Conditions of Licenses," and 10 CFR 50, Appendix G, "Fracture Toughness Requirements" based on the use of the Master Curve methodology. The LAR was proposed as a means to provide additional operating margin during plant heatup and cooldown activities and to provide an alternative method for assessing radiation effects on the reactor pressure vessel materials.

Various nuclear industry organizations (IAEA, ASME and ASTM) are planning to issue several consensus standards in the year 2003 that will provide criteria on how to treat fracture toughness data. These documents, and the continuing development of the understanding of the direct measurement methodology, may result in industry-wide acceptable guidance on the treatment of fracture toughness data. At that time FENOC may resubmit a LAR requesting the adoption of the Master Curve Methodology for BVPS Unit No. 1.

In the cover letter that transmitted LAR 297, FENOC requested deferral of NRC review of the change to the Capsule X withdrawal schedule which was requested by FENOC letter L-01-027 dated March 7, 2001. The deferral was requested because the capsule 0 \\

Since LAR 297 is now being withdrawn, FENOC requests NRC approval of the Capsule X withdrawal schedule shown in Table 7-1 of WCAP-15571 "Analysis of Capsule Y from Beaver Valley Unit 1 Reactor Vessel Surveillance Program" which was perviously transmitted with letter L-01-027 dated March 7, 2001.

Following NRC approval of WCAP-15571, Table 4.5-3 of the BVPS Unit No. 1 Updated Final Safety Analysis Report (UFSAR) will be revised to reflect the Capsule X withdrawal schedule.
