Dear Sir:
This application for an amendment to the James A. Fitzpatrick Technical Specifications proposes operability and surveillance requirements for the reactor vessel overfill protection instrumentation that initiates feedwater pump turbine and main turbine trips on high reactor vessel water level. The proposed Technical Specifications comply with an NRC request (Reference 1), and resolves an NRC concem regarding reactor vessel overfill (Reference 2).
The Authority committed to submit the enclosed application in Reference 3.

The Authority requests that all provisions of the proposed amendment, except for the calibration and Logic System Functional Testing (LSFT) requirements, take effect 60 days after the issuance of the amendment. This time is needed to accommodate the associated procedural changes and training. The Authority requests that the calibration and LSFT requirements take effect during the first plant refueling outage after the issuance of the amendment.

Specification pages, respectively. A copy of this application and the associated attachments is being providctl to the designated New York State official in accordance with 10 CFR 50.91.

The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating Ucense DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulations.
This application proposes operability and surveillance requirements for the reactor vessel overfill protection instrumentation that initiates feedwater pump turbine and main turbine trips on high reactor vessel water level.
Attachments I, ll, and til to this application contain the proposed revisions to the Technical Specifications, the associated safety evaluation, and the marked-up Technical Specification pages, respectively.
