SUBJECT: NRC ISFSI SECURITY INSPECTION REPORT 05000454/2009-404(DNMS); 05000455/2009-404(DNMS) - BYRON GENERATING STATION

Dear Mr. Pardee:

On May 11, 2009, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection of the Independent Spent Fuel Storage Installation (ISFSI) at the Byron Generating Station, Byron, Illinois. The purpose of the inspection was to evaluate whether the protection of the ISFSI was in compliance with the Byron Physical Security Plan and the NRC Order EA-08-

069, "Issuance of Order for Implementation of Additional Security Measures and Fingerprinting for Unescorted Access for Byron Generating Station Independent Spent Fuel Storage Installation," dated April 2, 2008. In addition, the inspector determined whether the use and storage of your instrument calibrator was conducted safely and in accordance with 10 CFR Part 20 requirements. At the conclusion of the on-site inspection on May 11, 2009, the inspector discussed the inspection findings with members of your staff.

Based on the results of this inspection, no findings of significance were identified.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related discussion contained in the enclosure, and in accordance with 10 CFR 2.390, a copy of this letter's enclosure will not be available for public inspection.

Enclosure Contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, this transmittal document is decontrolled. Attachment 3 We will gladly discuss any questions you may have regarding this inspection.
