SUBJECT:

INDIAN POINT UNIT 3 - NRC INSPECTION REPORT NO. 50-286/01-011

Dear Mr. Barrett:

On December 13, 2001, the NRC completed a team inspection at your Indian Point Unit 3 Nuclear Power Station. The enclosed report documents the results of that inspection which were discussed with you, and other members of your staff, on December 13, 2001.

This inspection was an examination of activities conducted under your license as related to safety and compliance with the Commissions rules and regulations and with the conditions of your license. Within these areas, the inspection consisted of a selected examination of procedures and representative records, observation of activities, and interviews with personnel.

Based on the results of this inspection, the team identified two findings that were determined to be of very low safety significance (Green). Both issues were determined to involve violations of NRC requirements. However, because of their very low safety significance and because they have been entered in your corrective action program, the NRC is treating these issues as non-cited violations in accordance with Section VI.A.1 of the NRCs Enforcement Policy. If you deny the non-cited violations, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN.:

Document Control Desk, Washington, D.C. 20555-0001, with copies to the Regional Administrator, Region I, the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, D.C. 20555-0001, and the NRC Resident Inspector at the Indian Point Unit 3 Nuclear Power Station.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS).
