Dear Mr. Ventosa:

On August 16,2012, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at youilndian Point Energy Center, Units 2 and 3. The inspection covered one or more of the key attributes of the security cornerstone of the NRC's Reactor Oversight Process. The enclosed inspection report documents the inspection results which were discussed on August 16,2.012, with Don Mayer, Acting Site Vice President and Director of Unit 1, Patric Conroy, NSA Director, and other members of your staff.

The inspection examined activities conducted under your licenses as they relate to security and compliance with the Commission's rules and regulations and with the conditions of your licenses. The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel.

Two NRC identified findings of very low security significance (i.e., Green as determined by the Baseline Security Significance Determination Process) were identified during this inspection'

The deficiencies were promptly corrected or compensated for, and the plant was in compliance with applicable physical protection and security requirements within the scope of this inspection before the inspectors left the area.

Both of these findings were determined to involve violations of NRC requirements. Further, two licensee-identified violations which were determined to be of very low security significance are listed in this report. The NRC is treating these violations as non-cited violations (NCVs)

consistent witfi Section 2.3.2 of the Enforcement Policy. lf you contest these NCVs in the enclosed report, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region l; the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Senior Resident Inspectors at Indian Point Units 2 and 3.

Enclosure contains Sensitive Unclassifi ed Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled.

Ventosa 2 Two cross-cutting aspects were assigned to the findings in the areas of Human Performance because Entergy did not ensure that sufficient qualified personnel were available to maintain work hours within working hour guidelines, and also did not plan and coordinate work activities consistent with nuclear safety by incorporating the need for planned contingencies and compensatory actions taken on security systems (H.2(b) and H.3(a)). lf you disagree with a cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the Regional Administrator, Region I and the NRC Resident Inspector at Indian Point Energy Center and to the Branch Chief, Security Performance Evaluation Branch.

ln accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's Agencywide Document Access and Management System (ADAMS).
