SUBJECT: MILLSTONE POWER STATION UNITS 2 AND 3 - NRC BASELINE SECURITY INSPECTION REPORT 05000336/2014403, 05000423/2014403, AND NOTICE OF VIOLATION

Dear Mr. Heacock:

On May 28, 2014, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Millstone Power Station, Units 2 and 3. The NRC inspectors discussed the results of this inspection with Mr. Nelson Martin, Interim Director Nuclear Protection Services and Emergency Preparedness, and other members of your staff. Inspectors documented the results of this inspection in the enclosed inspection report. Based on the results of this inspection, the NRC evaluated a self-revealing finding under the Baseline Security Significance Determination Process as having very low security significance (Green). The NRC has also identified one violation of NRC requirements associated with this finding. This violation was evaluated in accordance with the NRC Enforcement Policy. The current Enforcement Policy is included on the NRC's website at http://www.nrc.gov/aboutnrc/regulatory/enforcement/enforcement-pol.html. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding it are described in the enclosed inspection report. This violation meets the criteria in Section 2.3.2.a of the NRC Enforcement Policy to disposition it as a non-cited violation. However, the NRC is issuing a Notice of Violation because of Millstone's failure on two previous occasions to identify this issue and to require a response from Millstone regarding, in part, its planned long-term corrective actions. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC review of your response to the Notice will also determine whether enforcement action is necessary to ensure compliance with regulatory requirements. Enclosure contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled. A cross-cutting aspect was assigned to the finding in the area of Problem Identification and Resolution, Corrective Action Program, because Millstone failed to thoroughly evaluate an issue to ensure that resolutions address causes and extent of conditions commensurate with their safety significance (P.2).

Additionally, NRC inspectors documented two self-revealing findings and one licensee-identified finding of very low security significance (Green) in this report. The deficiencies were promptly corrected or compensated for, and the plant was in compliance with applicable physical protection and security requirements within the scope of this inspection before the inspectors left the area. These findings involved violations of NRC requirements. The NRC is treating these violations as non-cited violations (NCV) consistent with Section 2.3.2.a of the Enforcement Policy. If you contest the violations or significance of these NCVs, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region I; the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC resident inspector at the Millstone Power Station, Units 2 and 3. One cross-cutting aspect was assigned to one of the self-revealing findings in the area of Human Performance because the licensee failed to recognize and plan for the possibility of mistakes, latent issues, and inherent risk, even while expecting successful outcomes (H.12). If you disagree with a cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the Regional Administrator, Region I; and the NRC Resident Inspectors at the Millstone Power Station, Units 2 and 3. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, "Public Inspections, Exemptions, Requests for Withholding," of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC's Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR §2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the PARS component of NRC's ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response "Security-Related Information - Withhold From Public Disclosure Under 10 CFR §2.390" in accordance with CFR §2.390(d)(1) and follow the instructions for withholding in 10 CFR §2.390(b)(1). In accordance with 10 CFR §2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
