INSPECTION REPORT NO. 50-245/90-01 AND REPORT OF INVESTIGATION CASE NO. 1-90-008 This letter refers to the routine safety inspection conducted by Mr. James M. Trapp on January 8-12,1990, at the Millstone Unit 1 Nuclear Power Station in Waterford, Connecticut.
A discussion of our findings was held by Mr. Trapp with Mr. Scace at the conclusion of this inspection. In addition, an investigation of this matter was conducted by the NRC Office of Investigation. A copy of the synopsis of the investigation report is also enclosed.
Areas examined during this inspection were events related to the Licensee Event Report (LER)
No. 89-22, which reported the feedwater coolant injection (FWCI) system inoperability on November 17, 1989. The OI investigation reviewed (1) the alleged willful delay by licensee management to evaluate FWCI operability until the required modification was ready to be implemented; and (2) the alleged harassment and intimidation of a Northeast Utilities employee, in order to influence the results of a reportability determination regarding the operability of the feedwater coolant injection system, and in retaliation for the employee's technical evaluation and concluiion regarding the safety system.
Based on the NRC inspection and the OI investigation, two apparent violations were identified that are being considered for escalated enforcement action in accordance with the " General.
Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy),.
The.first apparent violation was identified during the NRC inspection. The inspector determined that adequate information was available on June 15,1989 -
to initiate the formal operability determination process of the feedwater coolant injection (FWCI)
system. However, the formal process to evaluate the operability of the FWCI system, using the reportability evaluation procedure, was not initiated until October 10,1989. The administrative procedure requirement to determine operability /reportability was not met in that the final FWCI operability determination was made on November 17,1989, which was 7-days beyond the 30-day requirement. In additien, the OI report concluded that there was a deliberate delay in declaring the FWCI system inoperable.

Mr. John The second apparent violation is documented in the 01 investigation report which determined

that the engineer, who identified that the FWCI system was inoperable, was harassed by Millstone Unit 1 management. This report concluded that the engineer was harassed in an effort to influence his evaluation of the safety system and discriminated against by not being selected to fill a personnel vacancy in Millstone Unit 1 Engineering in retaliation for his technical
evaluation and conclusion that were subsequently used as a basis for declaring the FWCI system inoperable.
You will be contacted by my staff to schedule an enforcement conference to discuss these apparent violations. The purposes of this conference are to discuss the apparent violations, their causes and safety significance; to provide you the opportunity to present your proposed
