Inspection Summary

Inspection on July 14-16. 1993 (Recort No. 50-186/93003(DRSS))

Areas Inspected:

Special Nuclear Material Control and Accountability inspection including possession, use and accounting of Special Nuclear Material (SNM).

Results: The licensee was found to be in compliance with NRC requirements in-the areas examined. One previous violation concerning verification of Special Nuclear Material upon receipt was closed. Two previous open items pertaining to monthly vault inventories and designation of certain Special Nuclear Material on the Material Balance Report were closed.

' The licensee's written and implemented program for controllino and accounting of receipt, storage, inventories, burnup-related measurements and calculations, shipments, and records and reports was adequate and effective for controlling Special Nuclear Material in their possession.

The licensee was found to have limited their possession-and use of Special Nuclear Material to the locations and purposes authorized under their license.

The licensee has requested a change to the R-103 license to allow a temporary increase of the U-235 possession limit to 60 kg because fuel shipping dates were uncertain and the receipt of new fuel could be affected. Approval of the amendment request was pending by the Office of !aclear Reactor Regulation.

At the beginning of the inspection, the Research Reactor Director and other members of his staff were briefed on the purpose and scope of the

inspection.

j The inspector met with the licensee representatives denoted in Section j

1 on July 16, 1993. A brief description of the scope of the inspection I

was provided.

The inspector advised the licensee that there were no violations,

deviations, unresolved items, or inspector followup items identified i

during this inspection.

The matter of the licensee's request dated April 30, 1993, to NRR for

approval of an amendment to the facility license to allow a. temporary-i increase of the U-235 possession limit to 60 kg was briefly discussed.

The inspector stated'that he would call NRR the following week regarding the status of this request.

Licensee management verbally committed to assuring that all future receipts of SNM would be properly verified.

The inspector verified with the SNM custodian during an inventory conducted during this inspection, that the contents of all shipments subsequent to the last inspection were verified in accordance with the SNM accountability manual. No discrepancies were noted. This item is closed.

(Closed) Open Item (Report No. 50-186/91002-02(DRSS):

This open item was described in Section 4.b of that report.

The licensee was not including the new fuel assemblies as part of the monthly-inventory in the vault in accordance with their SNM Accountability Manual.

The licensee's monthly inventory committed to in their SNM Accountability Manual exceeded the 12 month regulatory requirement. At the exit meeting the licensee committed to revising the monthly inventory form to include the new fuel assemblies stored in the vault.

The inspector confirmed by observation that new fuel assemblies in-the SNM vault are accounted for on a monthly basis and that the inventory form was revised to reflect inclusion of the assemblies in the review. This item is closed.

(Closed) Open Item (Report No. 50-186/91002-03(DRSS): This open item was described in section 4.c of that report. The licensee had erroneously identified some enriched uranium as material type E-3 that should have been properly categorized on line 5 of form-742 as E-1, E-2, or E-4.

The E-3 material determination was based upon an averaging of enrichments of various types _of SNM which had been a practice of the licensee since 1975.

Inspection showed that the licensee had submitted corrected copies of form 742, Material Balance Report, to the Martin Marietta Corporation to accurately reflect their uranium possession by type. This item is closed.

The licensee is authorized to receive, possess, and use up to 45 kilograms of contained uranium-235 of any enrichment, providing that no

more than 5 kilograms of this amount be unirradiated.

In a letter to

.

the NRC dated April 30, 1993, the licensee requested approval of an

]

amendment to their licensee to temporarily increase the limit for i

possession, receipt, and use of contained uranium-235 to 60 kilograms of i

which not more than 5 kilograms may be in an unirradiated state until

May 31, 1994, for the purpose of maintaining uninterrupted reactor operation pending the establishment of a capability for the off-site

shipment of spent fuel and the actual shipment of the spent fuel accumulated prior to the establishment of that capability.

i Discussions with the licensee's SNM custodian confirmed that the reasons i

for the amendment request was that their spent fuel shipping plans have j

become less assured because DOE (Savannah River) has indicated that they j

cannot guarantee receipt of MURR fuel by August 6, 1993, because the

BMI-l cask is going to be used to ship HEU spent fuel from the University of Virginia.

The licensee's amendment request was under review by NRR at the

'f conclusion of this inspection.
