5.
Disposition of Materials a.
This preliminary inspection revealed that irradiated fuel from the R-3 reactor has been shipped to SR00. The first shipment on November 11, 1979 was observed by a Region II inspector (Report No. 50-111/79-3) and no discrepancies were observed. The second shipment to SR00 was made on November 13, 1979. The inspector reviewed the licensee's " Nuclear Material Transaction Reports" for the two shipments (ATTACHMENTS A&B),
and had no questions.
Receipt of the shipments was verified by the authorized official at SR00.
The inspector observed that the fuel storage trench in the floor of the R-3 bay was empty.
Four unirradiated R-3 fuel elements were transferred to the North Carolina State University PULSTAR reactor facility which is located immediately adjacent to the R-3 facility. A five curie plutonium-beryllium neutron source was also transferred to the PULSTAR facility. The unirradiated fuel and neutron source are possessed under PULSTAR License No. R-120, Amendment 6 (Attachment C) issued September 17, 1980 in response to the licensee's application dated January 4, 1980.
The four unirradiated R-3 fuel elements were observed by the inspector to be stored in a three combination lock safe located on the PULSTAR Bay floor. The SNM of low strategic significance is secured in accordance with 10 CFR 73.67(f).
The plutonium-beryll t um neutron source was also observed to be stored in a secure area of the PULSTAR facilit.

The licensee is continuing the dismantling and decontamination of the R-3 facility.
Materials containing activation-products and perhaps some contamination remain in the reactor bay, therefore, verification that licensable material is no longer present could not be accomplished at the time of this inspection. This determination will be made at the time of a final inspection and survey.
6.
Confirmatory Survey A review of licensee records of surveys and decontamination efforts revealed that systematic and thorough efforts have been made to eliminate residual contamination.
These efforts are continuing and upon completion of the dismantling, decontamination and final survey by the licensee, a complete review of the program and a verification survey will be performed in a final inspection.

The Nuclear Regu'atory Commission (the Commission) has found that:

A.
Thr. applicaticn for cmendm2nt by the North Carolina State University at Raleigh (the licensec) dated January 4,1980, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended l
(the Act), and the Commission's rules and regulations sat forth in 10
.CFR Chapter I; I
B.
The facility will operate in conformity with the application, the pro-visions of the Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D.
The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission"s regulations and all applicable requirements have been satisfied; and F.
Publication of notice of this amendment is not required since it does not involve a significant hazards con *,ideration nor amendnent of a ' license of the type described in 10 CFR Section 2.106(a)(2).

Accordingly, paragraph 2.B.(2) of Facility License No. R-120 is hereby amended to read as follows:
(2) Pursuant to the Act and Title 10, Chapter I, CFR, Part 70, "Special Nuclear Material", to receive, possess, and use in connection with operation of the reactor up to 435 kilograms of uranium, including no more than 1.0 kilogram of highly enriched uranium, and up to 200 grams of plutonium-239 in the form of plutonium-beryllium neutron sources.
3.
This license amendment is effective as of the date of its issuance.
