NORTHSTAR VALLECITOS LLC - NRC INSPECTION REPORT 05000070/2025002; 05000073/2025002; 05000183/2025002; and 07000754/2025002

Dear Luke M. Self:

On December 5, 2025, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at your NorthStar Vallecitos Nuclear Center. At the conclusion of the inspection, the inspectors discussed the results of the inspection with Adam Ball, Site Superintendent, and other members of your staff. The results of this inspection are documented in the enclosed report.

Based on the results of this inspection, the NRC has determined that one Severity Level IV violation of NRC requirements occurred. The violation involves your failure to conduct decommissioning of Building 103, the Metallurgy, Chemistry and Ceramics Laboratory, in accordance with an NRC-approved decommissioning plan. Because you initiated a condition report to address this issue, this violation is being treated as a Non-Cited Violation (NCV)

consistent with Section 2.3.2.a of the Enforcement Policy.

The NCV is described in the subject inspection report. If you contest the violation or the significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN:

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) conducted an announced, routine inspection of decommissioning activities in progress at the NorthStar Vallecitos Nuclear Center in Sunol,

California.

List of Findings of Significance and Violations Decommissioning of Building 103 prior to Approval of a Decommissioning Plan Section RM-01 Severity Level IV NCV 07000754/2025002-01 Opened and Closed IP 87104 Introduction: Inspectors identified a Severity Level IV, Non-Cited Violation (NCV) of 10 CFR Part 70.38(g) for the licensees decommissioning of Building 103 prior to NRC approval of a decommissioning plan.

SITE STATUS Control of the NRC licenses for the Vallecitos Nuclear Center were transferred from GE Hitachi Nuclear Energy to NorthStar Vallecitos LLC in mid-March 2025 (Agencywide Documents Access and Management System [ADAMS] ML24053A060). At the time of the inspection, decommissioning preparation activities were ongoing in several locations around the site including asbestos abatement, legacy waste removal and disposal, and demolition preparation work.

INSPECTION SCOPES

The inspection was conducted using the appropriate portions of the inspection procedures (IPs).

Currently approved IPs are located on the public website at http://www.nrc.gov/reading-rm/doc-collections/insp-manual/inspection-procedure/index.html. The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel to assess licensee performance and compliance with Commission rules and regulations, license conditions, site procedures, and standards. The inspection was declared complete when the objectives of the IP were met, consistent with Inspection Manual Chapters (IMCs) 2561, Decommissioning Power Reactor Inspection Program, IMC 2545, Research and Test Reactor Inspection Program, and IMC 2602, Decommissioning Fuel Cycle, Uranium Recovery, and Materials Inspection Program.

IP 71801 - Decommissioning Implementation and Status Status of Decommissioning (IP Section 03.01)

The inspectors conducted site tours, interviewed site staff, and reviewed selected records to observe the status of decommissioning. The inspectors:

(1) Discussed future decommissioning plans and associated licensing requirements with licensee staff
(2) Toured the Vallecitos Boiling Water Reactor (VBWR); General Electric Test Reactor (GETR); Empire State Atomic Development Associates Incorporated Vallecitos Experimental Superheat Reactor (EVESR); and the Nuclear Test Reactor (NTR)
(3) Toured various buildings and outdoor areas including the Hillside Storage Area Implementation of Regulatory and Licensing Requirements (IP Section 03.02)

The inspectors reviewed the:

(1) Annual Shutdown Reactor Reports for the year 2024 dated May 1, 2025 (ML25121A328)
(2) List of condition reports issued in 2025 in this program area
(3) Document NSV 25-022, Quality Assurance Program Manual, Revision 0 IP 83750 - Decommissioning Occupational Radiation Control Radiological Work Planning and Execution (Section 03.01)

The inspectors:

(1) Reviewed the licensees annual radiation program review, as documented in the internal report, Vallecitos 2025 Radiation Protection Program Review, dated June 30, 2025
(2) Reviewed the licensees implementation of its As Low As Is Reasonably Achievable (ALARA) program
(3) Reviewed the Minutes of ALARA/Radiation Safety Committee Meeting dated August 26, 2025
(4) Interviewed the radiation protection manager to discuss recent condition reports issued in the radiation protection program area Occupational Radiation Exposure Topical Areas (Section 03.02)

The inspectors:

(1) Reviewed the licensees 2025 worker dose records
(2) Reviewed recent contamination events as documented in the licensees contamination log
(3) Reviewed annual radiological survey results documented in the Annual Shutdown Reactor Reports for the Year 2024 dated May 1, 2025, for the VBWR, EVESR and GETR (ML25121A328)
(4) Reviewed the most current annual report for the NTR that included information about the highest radiation exposure (ML24103A024)

Problem Identification and Resolution (Section 03.03)

The inspectors reviewed the following condition reports and discussed the significance of the events with the radiation protection manager:

(1) Condition Report 2025000025, High smearable alpha contamination in Building 102, dated July 15, 2025; corrective actions included decontamination of the area
(2) Condition Report 2025000043, High alpha results on Building 102 in-place air samples, dated December 1, 2025 IP 86750 - Decommissioning Solid Radioactive Waste Management, Demolition, and Transportation of Radioactive Materials Radioactive Material Storage, Control, and Processing (IP Section 03.01)

The inspectors conducted site tours to observe decommissioning activities in progress. The inspectors:

(1) Toured Building 102 to observe if radioactive material was being stored in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 20 and 10 CFR Part 37 requirements
(2) Toured Building 102A to determine if ventilation systems and monitoring equipment were controlled and marked in accordance with10 CFR Part 20 requirements
(3) Toured Building 103 to determine the status of decommissioning and to determine if radioactive material was controlled and posted in accordance with (4)10 CFR Part 20 requirements
(5) Toured VBWR, EVESR, and GETR containments to determine if radioactive material was controlled and posted in accordance with 10 CFR Part 20
(6) Toured the Hillside Storage Area to observe implementation of 10 CFR Part 37 requirements
(7) Toured the Waste Evaporator Plant to determine if radioactive material was controlled and posted in accordance with 10 CFR Part 20 requirements
(8) Reviewed sealed source inventory records and toured the locations where sealed sources were stored to determine if the sealed sources were controlled, marked, leak tested, and inventoried in accordance with 10 CFR Part 20 Transportation of Radioactive Materials (IP Section 03.02)

The inspectors verified shipments containing radioactive material were prepared and shipped in accordance with regulatory and licensee requirements. The inspectors:

(1) Toured areas where Sealand containers of low specific activity (LSA) waste were staged awaiting transportation off site to determine if containers were marked and labelled in accordance with 10 CFR Part 20 and 49 CFR Part 172 requirements; inspectors also performed independent radiological surveys to determine if radiation levels were in accordance with 49 CFR Part 173 limits
(2) Reviewed three completed shipping packages to determine if the packages were complete and determine if the drivers were provided with all documentation required in accordance with 49 CFR Part 172 requirements
(3) Reviewed records for surveys, analysis and disposition of a contaminated glovebox to determine if the glovebox was packaged and shipped in accordance with 49 CFR Part 172 and 10 CFR Part 71.5 requirements
(4) Interviewed waste manager to discuss volume of waste shipped since July 29, 2025, and volume of waste to be shipped before completion of calendar year 2025
(5) Reviewed sample of training records to determine if personnel who were packaging, labeling, and signing waste packages were trained in accordance with 10 CFR Part 71.5 and 49 CFR Part 172.704 requirements

The inspectors:

(1) Toured Building 103 to observe status of demolition and discuss disposition of removed material and equipment.
(2) Interviewed the work control manager regarding demolition work plans for future decommissioning and associated work plans for all buildings. Discussion included structures to be evaluated for free release, decontamination prior to demolition, contamination control during demolition, and disposition of material after demolition.
(3) Interviewed regulatory affairs manager and work control manager to verify licensee had NRC authorization to begin decommissioning work in GETR, EVESR, and other structures where demolition and decommissioning were scheduled.
(4) Reviewed licensee procedures implemented for decommissioning work, including the following work packages:

The inspectors reviewed the licensees condition reports in the areas of radioactive material storage and control, transportation of radioactive materials, and demolition and disposition of radiologically impacted structures.

IP 69002 - Class III Research and Test Reactors Staffing and Audits (IP Section 02.01)

The inspectors reviewed:

(1) Section 6.1, Organization, of the NTR technical specifications (ML24031A622 and ML24053A121) with a licensee representative
(2) The Minutes of the Vallecitos Technological Safety Council/Nuclear Test Reactor Oversight Committee Meeting dated September 30, 2025, which included an assessment of the NTR audit reports
(3) The Minutes of ALARA/Radiation Safety Committee Meeting dated August 26, 2025, which included a review of the NTR Operator Requalification and Active License Status (IP Section 02.02)

The inspectors discussed the NRC-approved technical specifications with a licensee representative including the operator requalification program and current license status.

Radiological Surveys (IP Section 02.03)

The inspectors:

(1) Reviewed the Annual Shutdown Reactor Reports for the Year 2025 dated May 1, 2025 (ML25121A328), which included interior survey results for the GETR
(2) Reviewed the Annual Report No. 64 for the Year 2023 dated April 12, 2024 (ML24103A024), which included a summary of radioactive discharges, environmental surveys and radiation exposures for the NTR. The next biennial report is expected to be submitted in early 2026.
(3) Toured the reactor room, in part, to observe current radiological conditions Surveillance (IP Section 02.04)

The inspectors:

(1) Interviewed a reactor operator and discussed the status of technical specifications including surveillance requirements
(2) Reviewed Condition Report 2025000030, Question Arose During the NRT Annual Audit Regarding the Need to Perform Daily Channel Checks for NRT Cell Negative Pressure Per Tech Spec 4.5.1, dated August 16, 2025, involving the need to perform a daily channel check of the NTR cell differential pressure instrument Emergency Preparedness (IP Section 02.05)

The inspectors reviewed the site emergency plan, procedure for notifications and reporting of events and conditions, and procedure for emergency classifications and notifications during the June 2025 inspection (ML25209A567).

IP 64704 - Decommissioning Fire Protection Program Fire Protection Program (IP Section 03.01)

The inspectors:

(1) Interviewed the emergency preparedness program manager and discussed the status of the fire protection program
(2) Reviewed procedure NVNC-ER-613, Fire Protection and Response, revision 1 Fire Area Walkdown and Work Observations (IP Section 03.02)

The inspectors:

Security and Control of Radioactive Materials (IP Section RM-03)

The inspectors:

(1) Observed site perimeter features and access points including fences, gates, and personnel entry points
(2) Observed security features at locations where special nuclear material (SNM)was stored
(3) Discussed SNM security features with site staff Waste Generation, Storage and Transportation (IP Section RM-04)

The results of the inspectors review of the waste generation, storage, and transportation activities for license SNM-960 are provided in section IP 86750, Decommissioning Solid Radioactive Waste Management, Demolition, and Transportation of Radioactive Materials, of this inspection report.

Public Dose, Effluent Releases and Environmental Monitoring (IP Section RM-05)

The inspectors:

(1) Observed the operation of effluent discharge air samplers at several SNM locations of use
(2) Reviewed the 2024 Effluent Monitoring and Environmental Surveillance Programs Annual Report dated March 5, 2025 (ML25064A344), required by SNM-960 license condition S-4.

Management Organization and Controls (IP Section RM-06)

The inspectors reviewed the:

(1) Vallecitos 2025 Radiation Protection Program Review, dated June 30, 2025, which included activities conducted under license SNM-960
(2) Minutes of ALARA/Radiation Safety Committee Meeting, dated August 26, 2025, which included activities covered under license SNM-960

INSPECTION RESULTS

Decommissioning of Building 103 prior to Approval of a Decommissioning Plan Report Section RM-01 Severity Level IV NCV 07000754/2025002-01 Opened and Closed IP 87104

Introduction:

Inspectors identified a Severity Level IV, Non-Cited Violation (NCV) of 10 CFR Part 70.38(g) for the licensees decommissioning of Building 103 prior to NRC approval of a decommissioning plan.

Description:

The inspectors noted that the licensee was conducting decommissioning in Building 103, the Metallurgy, Chemistry, and Ceramics Laboratory. Building 103 is listed as a location of use in the SNM license. The activities in progress included removal of ventilation system and walls within the building. These activities should be conducted using the instructions provided in an NRC-approved decommissioning plan or NRC-approved procedures. The inspectors determined that the licensee did not have an NRC-approved decommissioning plan or NRC-approved procedures.

Corrective Actions: The licensee suspended the decommissioning activities of Building 103 and plans to submit to the NRC a decommissioning plan and/or procedures.

Corrective Action Reference: Condition Report 2025000047

Analysis:

The licensees actions were found to be comparable to Materials Operations Example 6.3.d.3 of the Enforcement Policy, in that the licensee failed to implement approved procedures. Specifically, the licensee was conducting decommissioning in Building 103 without NRC-approved procedures. The safety significance was determined to be low because radiological controls were in place during the work activities.

Enforcement:

Severity: This issue was determined to be a Severity Level IV, non-cited violation, consistent with NRCs Enforcement Policy, dated August 23, 2024, as informed by materials operations example 6.3.d.3. Specifically, the licensee placed the violation into its corrective action program and plans to develop and implement corrective actions.

Violation: 10 CFR Part 70.38(g)(1) states, in part, that a decommissioning plan must be submitted if procedures and activities necessary to carry out decommissioning of a building have not been previously approved by the Commission and these procedures could increase potential health and safety impacts to workers or to the public. 10 CFR Part 70.38(g)(3)states, in part, that the procedures listed in paragraph (g)(1) of this section may not be carried out prior to approval of the decommissioning plan.

Contrary to the above, from July 2025 through November 2025, the licensee conducted decommissioning activities within Building 103 without an approved Decommissioning Plan.

The decommissioning work included removal, disposal, and shipment of equipment used to perform work with SNM (e.g., drain piping, fume hoods, ventilation ducting, and a glovebox)from Building 103. The decommissioning procedures used by the licensee to conduct the work had not been approved by the NRC and the work could have increased the potential health and safety impacts to workers.

Enforcement Action: This violation is being treated as a non-cited violation, consistent with Section 2.3.2. of the Enforcement Policy.
