I This is in reference to NRC's inspection conducted on April 20-23,1998, of University of

. California, San Diego's (UCSD) use of radioisotopes on the high seas in areas where the NRC maintains regulatory jurisdiction. The inspection findings were discussed with you on July 28,

Based.on our inspection of UCSD's activities in NRC jurisdiction,'certain of your activities appeared to be in violation of NRC requirements. The violation involved the failure to obtain an ,
NRC specific license as required by 10 CFR 30.3 prior to using radioisotopes in an area of exclusive Federal jurisdiction aboard research vessels on the high seas during 1998. t

. representatives had not obtained a specific license under 10 CFR 30.3 or filed a Form 241 with the NRC. Normally, violations of this typ? are classified at Severity Level ill and monetary civil

penalties are considered in accordance with the NRC's " General Statement of Policy and .
L Procedure for Enforcement Actions (Enforcement Policy)," NUREG-1600, copy enclosed._ in
, this case, however, the NRC is exercising enforcement discretion as provided for in Section
. ,Vil.B.6 of the Enforcement Policy to not take any enforcement action for this violation. This is L based on the confusion surrounding the applicability of 10 CFR 30.3 and .150.20(c) to l- Agreement State licensees conducting licensable activities on the high seas.- I also note that i you filed an NRC Form 241 for these activHies on April 6,1998. Therefore, after consultation ,
! with the Director, Office 'of Enforcement, I have been authorized to exercise enforcement discretion and not issue an enforcement action for UCSD's yiolation of these requirements.
- - Nonetheless, UCSD is on notice of the existence of these requirements and the NRC's enforcement policies, and enforcement action may be taken for such violations in the future.
